What a pickle - SOA for DMP, please advise

The debt is with Moorcroft. I had court papers through from Northampton CC in January (I didn't contest them) and we received a letter from Moorcroft in March stating that judgement had been made in their favour and as a result "the court has been asked to apply an installment rate of £250 p/m to be ordered and the first payment to reach them by no later than 12/04/10". We didn't receive any letters from the court directly confirming this amount or confirming judgement.
To date no payments have been made. This afternoon we received another letter from Moorcroft (dated 01/07/10) stating "In one last effort to come to an arrangement to prevent the recommending of possible court action we will be prepared to accept payment by installments of £27.29 per month".
"Unless a payment is received by 10.00am on 08/07/10 we recommend court proceedings to be commenced against you without further notice".
So, now I'm confused as to what to do. Try and pay the £27.29 in the hope it doesn't jeopardise a possible DRO application or make a token payment. Also, after reading what I have just typed I'm now starting to think that it hasn't got to CCJ stage (but we received the documents from court??)
I won't be able to pay the pursue the DRO until I've seen the CAB money advisor, which won't be for 4-5 days I believe.
Yes, phone Northampton Court. You have the phone number and the claim reference so they can tell you what (if any) judgement was made. I suspect that the judgement was for £250 p/m. You have defaulted on it and they are considering what to do next.
If you want/need to stall you should then apply to vary on an N245

However, I wouldn't bother doing that unless Moorcroft actually apply for a warrant of execution (court bailiff) and then you would use the N245 to 'suspend the warrant' and 'vary the order'. There's a £35 fee I think so really I'd prefer to see that money go on the barcode for your DRO.
In any event your best course of action is to push ahead with the DRO. Once it's submitted, most seem to be approved in 24 hours.
But before that your Approved Intermediary is going to have to apply for a copy of your Experian credit file and that seems to be taking 3-4 weeks (we have to use a standard form for a free report). If you could get online and get yourself a print-out I think you could do it in a few days. If you follow Martin's guide you can get paid a fiver for doing it!

The AI can generate a barcode for you in a couple of minutes so you could very quickly have everything that you need.

I rang Northampton CC this morning and they did confirm the judgement and amount. As I said earlier I didn't hear anything directly from them so thought that was the norm. Thanks for the links and I will take your advice on this to try and hold off with Moorcroft, in the meantime I'll download and printoff my credit report for they next appointment with the CAB.:T

We had our appointment with the CAB Debt Advisor/AI today, lovely lady. She explained all the options (i.e DMP, DRO, BR) to us and was impressed by our knowledge of those options. I explained I had received some invaluable info from MSE members and was very pleased to hear that she recommended the forum to her clients for support. In talking about our SoA the advisor said that Housekeeping expenditure looked a little high, but the other expenditure was well below the trigger figures for a family our size. So in her opinion it all looked ok.
Based on the figures we submitted she recommended either a DRO in my name or one for my husband also. Alternatively, we could look into a DMP for my husbands debt. We explained that as the total debt was fast approaching the 15K criteria figure we wanted to speed up the process as quickly as possible. Based on advice we received (thanks fb) we already had a copy of my Equifax credit report with us, but the lady needed the others from Experian and CallCredit to cross reference. She advised us to download and print the other 2 credit reports and then call each creditor on Monday and ask what the amount owed to each will be by the end of the week. If we could do this by Tuesday she will make another appointment for us on Thursday.

The Experian report is the critical one, as the DRO unit does cross-check against it. Unfortunately it is the slowest one to obtain, even if, as in your case, the client is doing it him/herself.
They are working on giving the AI online access, which can'tcome quick enough for me as it's giving every DRO a minimum 3-4 week delay.
If she's asking for balance figures by the end of of the week, it sounds like she's intending to submit it after your apointment on Thursday. Shame the website is closed for submissions this week! Should be back on 26th0 -
Hi All,
just thought I'd update the thread.
We had our meeting yesterday morning with the AI at the CAB and went through the online DRO application (took about an hour). It looks as though the intended upgrade by the Insolvency Service was postponed. Had the barcode issued and managed to pay the £90.00 at the local Post Office. The AI advised that the timeframe for hearing from the Insolvency Service was normally a few days, providing I wasn't one of the cases they audited and wanted additional evidence from.
Earlier today we had a quick call from the AI telling us the IS had approved the DRO - Success! :T We are so pleased and a large weight has been removed from our shoulders (I can now get on with caring for my husband). I would like to say that if anyone has any reservations concerning looking into this for themselves then please don't. While I felt very guilty about the whole thing, the CAB were very non-judgemental during the whole process. They listened, advised and were very courteous and professional in their handling of our case.
