I did post this query (worded differently as i was quite strung out) last night but no-one has replied and i dont know what to do so here it is reworded. Can anyone offer any advice. Please!

I have various loans/credit cards etc which I am gradually whittling down and I always pay on time. On Monday morning, i noticed that the direct debit had not gone out for my Santander loan (it normally goes out on the 24th). It was one that used to be a cahoot one that they took over. I rang their customer services and they told me it would probably show in a few days. I knew the money was in the account waiting to be taken and that the direct debit was active (checked with online banking).

Yesterday evening i got home and found a letter from their collections office saying i hadnt paid it and to phone them. I phoned them and WHEN THEY CHECKED THEY SAID IT WAS THEIR FAULT, THEY HADNT EVEN TRIED TO CLAIM THE DIRECT DEBIT but despite this it would have an effect on my credit rating and they would have to write to the credit file people to take the black mark off which "may take a while".

I paid the money THEY HADN'T TAKEN over the phone there and then with a card. I am quite shocked by this. I dont know what to do because as soon as i realised they hadnt taken the money, I PHONED THEM! I am concerned that now I may get letters from other creditors telling me to pay up large chunks of money I cant afford because of Santanders error. I asked them for a letter explaining all this but was told it may take a few weeks.

I am very worried about how this terrible mistake by them will affect my credit and day to day living. I am also very angry that when I had rang their customer services that morning no problem was highlighted. I do have all the names/times/call refs of conversations I have had.

Why should they? Have you defaulted on the other accounts?

As long as you don't default on any of the debts, each one can't demand more than the contractual minimum.

Santander should remove any adverse payment info on your credit files. Check them to make sure they do. If they haven't within a reasonable time, then make an official complaint in writing. If they still don't sort it, you can take it to the Information Commissioner and FOS.

I will do. i have had another letter from them today saying there was an internal error but it doesnt specifically address this issue so have documented everything and will write in afew weeks if i dont hear anything else.
I have no experience of how this works so dont know what will happen so I suppose i fear the worst. For example i have a £1500 overdraft which is reviewed every year. Due to this error, I wouldnt want my bank saying next year they wont renew it because i wouldnt have the £1500 to find straight out.

Your overdraft can be taken away given 30 day notice for any reason. It is advisable not to live in your overdraft for this reason as the bank can demand it in full at basically any time, regardless of your circumstances, good or bad.

DC is absolutely correct, you must not depend on your overdraft, you need to reduce this as soon as possible.

DC, Congrats on the BSC, well done on the grade.
  • I have a very similar story to tell and will do my own thread about it.

Thanks for that re overdraft. Yeah -the letter from them last night said it was an internal error but then said the direct debit was not set up in time which is a load of rubbish as they took it in May and TWICE in April (their error AGAIN!) and it shows as active on my account!
I also spoke to an advisor there again yesterday who refused to give me an extension number/reference for him even though the man the previous day had done this no problem so this doesnt inspire confidence! He just kept saying i "didnt need it" (I'll be the judge of that....) I have therefore had to just note him on my records (which i keep very carefully) as "Rob - Geordie accent, sounds like in his late 20's" which is the best i can do. I hate Call Centres!
At least i have a letter saying there was an error anyway. God they are driving me mad with their incompetence!
I am trying to reduce my overdrafts (I have 2) but i have so many debts, it is difficult but will bear in mind what you have said. It is all coming down bit by bit.
