Claiming JSA after self-employed temp job?

Hi,
I was on JSA from December until April, but then came off JSA after being offered some temp admin work on a self-employed basis. The problem is, that it is a long way from my home, and the hours have become so sporadic and short that is is not even worth me continuing (for example, I may be asked to work 2 hours, but it would cost me that much just to get there!).
My question is, if I 'leave' this job (which is on a self-employed basis) will I be able to apply for JSA again immediately, or will I be told it was own choice to leave the job, despite the problems listed above?

Being self employed, why aren't you trying to generate more business? That's what self employed people do and that's what the DWP would have expected you to do. The fact your sole customer (and there's dodgy ground) has quietened off and is a bit of a distance away is no use. April and May were dead for me but thats a risk you take.
You can end your self employment and claim JSA but you will be sanctioned.0 -
Sorry, I perhaps didn't explain very clearly. I'm doing what would normally be an 'employed' job, i.e. temporary admin, but on a self-employed basis because that's how the organisation takes on temps.0

If the organisation is treating you as self employed just because it suits them, then this is unlawful and you are finding out the implications of accepting this situation. An employer cannot just decide to treat you as self employed - there has to be an actual relationship between you which states you are self employed. You need to refer to the instructions on the HMRC website regarding employed/self employed and take the test on that website. You then need to inform your employer that you believe you are an employee - if they do not accept this, you must inform HMRC. JSA is only available in a limited way to self employed people.0

Thanks for your response. I'm slightly confused as the job was advertised through the job centre as being on a self-employed basis, and I've also been told in the past when working for a multinational recruitment agency that I could choose to work on a self-employed basis with them also.
The main question I guess is what happens when I 'un-register' as self-employed, in terms of claiming JSA (whether this is now or when the work has simply finished).0 -

No you can't. It is HMRC who ultimately decide, not an employer nor an employee.0
