Help! Got CCJ due to overpayment from employer but was at Uni!

  • If you don't want your parents to open your mail, how about they forward it to you? Do you not get bank statements? Phone Bills? You have set yourself up here unfortunately. Maybe in future you'll be more vigilant. Good luck in getting the CCJ sorted.

    Like I said, I see all my phone bills and and bank statements online so no need for me.

    Ive never had to be vigilant about anything from the mail, unless I am expecting something important. Like I said, you dont go through your day to day life worrying about possibly being overpaid and having a ccj registered against you.

    Sucks for me I guess.

    I found the form, i've filled it out and I'll see how it goes from there.

    Moving On...

    You need to look to get the CCJ set aside on the grounds you never received the court papers, they were sent to an address you did not live at. It maybe your home address however you were at your term address so knew nothing of the court hearing or overpayment. It goes in your favour that the company had other contact details and knowledge you were not going to be at the address, however i do not believe you can counter claim costs since they are required to serve papers to an address, and if you never gave them your term time address there is nothing they can do about it. Setting aside costs about £75 to have it set aside and if successful so long as you pay the amount owed in full the CCJ will be like it never existed.
