    They weren't "duped" into it - they clearly agreed to the contract verbally on the phone.

    When the goods arrived, they made use of the service and they is further proof that they acknowledged that the service agreement existed.

    Service, you mean a few phone calls, that doesnt cut it to make hundreds of pounds in 'service'.


    Furthermore to that, they also paid some of the bill which again is further proof that they acknowledged the agreement.

    so? they can pay the rest but not HUNDREDS thank you for which they did not use



    I'm sorry but if they didn't want it, why did they use it and thus indicate their acceptance?

    Also it's not a £520 cancellation charge, it will be a small cancellation charge plus service charges for the remainder of their contracted months.

    This is completely standard when it comes to mobile phone service agreements and in fact, I was discussing similar charges with T-Mobile in one of their stores this very weekend.

    Legal my bum. There is nothing legal about this. It sound slike the op was coerced by a hardcore salesman on the phone.

    Thanks Vaproate and I have new info I have just spoke to my partner and I have misread the bill they sent, she has never payed 3G a penny on any occasion, I have rustled up a letter which will sent via recorded mail, I will update with the outcome.

    And thank you everyone else who has replied even the ones who think we should pay as we entered into an agreement, where the agreement was im not so sure.

    Should you find this phantom agreement, take it to a professional legal advisor, along with any other info to make double sure.

    How many here have a signed agreement for their pay monthly mobile phone that they took out online or over the phone?

    I know I haven't. I do know that I am 13 months through an 18 month deal.

    Should I stop paying as I haven't signed anything?? Obviously they won't be able to legally chase me for the remaining 5 months payments (£175) as that's unfairly high and they can't show me a signed agreement.
    Remember this: nothing worth doing is easy.

    What is your point? If its to try and tell the OP to pay something they d0ont owe then take a walk.

    I've already put my point across in this thread and I stand by it. You take the opposite view, which I respect entirely.

    The OP knows what they need to do now if they want to fight it. At no point have I said they should fork out the full amount though. Their credit file will already be trashed by this event so they have nothing to lose. Whether they end up getting the whole lot wiped off or have to pay something they'll learn from this and hopefully won't get into a similar situation in the future.

    I certainly wouldnt pay, and i wouldnt care about some mickey mouse credit report. Seeing as i dont plan on borrowing above my means. For which this recession is caused. ;)

    I totally agree with you. The problem lies with the OP's partner subsequently using the phone and then trying to forget about it. As I mentioned previously, if the phone had remained unused this matter would be clear cut and this thread already forgotten.

    Verbal agreement is enough, you then get a 7 day DSR (distance selling regulations) 'cooling off' period. By not returning the handset you have given full acceptance to the contract and the full terms of conditions recieved with the handset. I agree sales people are immoral but I am sure they will compromise on the cost for a full and final settlement. Hope this helps as before i worked for a phone company i would have thought that a signed document was necessary.
