Hi I received letter from Lowell financial this morning they have bought a debt of Capital one and I owe them 403.35 if I don't contact them in 5 days they will send round an agent to discuss repayment. Ive been thinking all day and I have no knowledge of this debt can some one please advise me of my next step thanks Denise..

You have contacted us regarding the account with the above reference number, which you claim is owed by ourselves.
We would point out that we have no knowledge of any such debt being owed to Capital One.
We are familiar with the ‘Office of Fair Trading Debt Collection Guidance’ which states that it is unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.
We would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable. In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.
Furthermore, ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.
We would ask that no further contact be made concerning the above accounts unless you can provide evidence as to our liability for the debt in question.
We await your written confirmation that this matter is now closed. Otherwise we will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
We look forward to your reply.

Hi
I've had trouble before from companies like this in the past. I sent them a letter, recorded delivery, asking them to send me a copy of the credit agreement I was supposed to have signed. Without this they can do nothing, and I never heard from them again. You can also ring up Consumer Direct who will give you loads of advice.

Hi i received photocopies of previous payment statements from LOWELL group today 27/8. last payment was 13/6/2007. But there is no copy of original agreement.
They want me to contact them with in 7 days to arrange payment.
With the prof they have should I arrange to make instalments0 -
Do you still not recognise the debt?I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)
As of the last count I have cleared [STRIKE]23.16%[/STRIKE] 22.49% of my debt.

If you have already requested your CCA and you've just had the statements back, send the reminder letter and enclose the £1 if you didn't last time. (Amend the letter accordingly)
