    As far as I'm aware the defintion of an HMO in council tax law for scotland has not been changed from that of E&W

    I used the E&W version as it was the first one to hand and was identical to the UK version

    The last amendment to the scottish version is this one
    Citation, commencement and amendment of the Council Tax (Liability of Owners) (Scotland) Regulations 1992
    1.These Regulations may be cited as the Council Tax (Liability of Owners) (Scotland) Amendment Regulations 2003 and shall come into force on 1st April 2003.

    2. - (1) The Council Tax (Liability of Owners) (Scotland) Regulations 1992URL="http://www.opsi.gov.uk/legislation/scotland/ssi2003/20030137.htm#note2"]2[/URL are amended as follows.

    (2) In the Schedule, for paragraph 3 there shall be substituted-

    • " 3. A dwelling occupied, or which could be occupied, by persons who do not constitute a single household and which is occupied by one or more persons each of whom-
      • (a) is a tenant of, or has a licence to occupy, part only of the dwelling; or

        (b) has a licence to occupy, but is not liable (whether alone or jointly with other persons) to pay rent or a licence fee in respect of the dwelling as a whole.".
    This confirms that for council tax purposes the law is the same in intention as in england and wales.

    The planning defintions and council defintions of HMOS are different.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    thanks for the replies,

    as far as i am concerned this is my home and the whole property is mine to live in and roam around freely in and i will just answer the questions in a bona fide manner,
