Smile And Bamk Charges

:o Hi folks, Just looking for a wee bit advice I sent a letter to smile on the 16th August standard template saying I want my bank charges back I reckon they owe me at least £600. I recieved a letter back saying we're sorry your unhappy, But please give us time to investigate blah blah blah however I actually wrote on the letter I wanted a answer in 7 days or I would be taking the to court. Now obviously I'd rather not go to Court but I want an answer for Smille is it wise to chase them up call email etc????

They've not answered after the standard reply.

  • Have you followed the set proceedures prelim wait 14 days the letter before action and wait 14 days?

    I have sent off for my statemenst from smile but they seem to be dealing at every moment possible!!

  • Yes its the Letter before action LBA you send now this says if you don't reply in 14 days then I will take you to court with no further warning.

    You will find the template on https://www.consumeractiongroup.co.uk - if you are not already registered you need to register to see the templates - I find them very helpful.

    I have only just sent off for my statemenst with smile so not got that far yet - they are taking their time keep asking me silly questions and even tried to charge me £10 per statements!!

    I have successfully claimed form HSBC though no problem - they paid up after I sent the LBA.

    Any problems findingthe letter you need I will be logging on about lunch time so will reply to you then.

    You need to look at consumeractiongroup.com/forums FAQs and familiarise yourself and pronto. You are SUING your bank, you may well go to court, some people have, and you need to be fully up to speed withwhat you are doing.

    Its 14 days prelim
    14 days LBA
    then if nothing, then to sue them via small claims

    saying that smile paid up for me within the first 14 days but my claim with them was only £ 30

  • Just to reiterate what Lynz has said - you need to read, re-read and read again everything in https://www.consumeractiongroup.co.uk. There is a set 'timetable' that many people have followed and successfully reclaimed their bank charges. It isn't a difficult procedure but there is a bit more to it than writing one letter then going to court.

  • Did you send your spreadsheet of charges and interest? If you get any part wrong, they use this to drag their feet cos they know you aren't entirely familiar with what you are doing. As mentioned before you can tackle that by becoming familiar, I'm especially concerned as you don't know exactly how much your owed back.

  • They cannot charge you £10 per statement, under the data protection act they can only charge you £10 for the whole lot. Again there is a template of this letter at https://www.consumeractiongroup.co.uk.

    How do you know what your charges are is you don't have your statemenst.

    You may be best going back to stage one and requesting your statements - your charges could be a hell of a lot more than you think they are and your need concrete evidence if it does go to court stage.

    Get on to the above site and as mention before get hot on the process then send your DPA letter - they have 40 days to reply
    then prelim letter giving 14 days for a reply
    then letter before action letter giving 14 days for a reply
    the take them to court.

    This is a set process and many people have won going through this process.

    If this is not followed and you are guessing at your charges it will not work - you must send them the DPA to start your process.

    It may seem lengthy but you have a much higher chance of winning this way.
