Have to be honest, I don't know I would be tempted to go in and pay the £500 to money shop, I can't see how anyone (expect those on here) would know that you've shown preference. Even better, ask your girlfriend to do it (with you in tow) then no one will know - unless you tell them, effectively she's buying your debt off them.
I'm not sure how much effort a bank would go to to class that as fraud, seeing as they have/will charge you that means they are benefiting at the tune of £5 a day!
You're not in a great situation but it's also your choice. I hope someone else can help you find another way out of this. Good luck with it.Today's Debt:
B/Card = £6,410 F/D = £3,190
Loan = £0 Woohoo!
Total Debt = £9500
Debt as of 26-1-11:
Total Debt = £14,3250 -
I think if you pay the Moenyshop in cash it should be OK, its like you never wrote the cheques as you will have torn them up.
They will no longer be creditors. Then they can be removed from the offical DRO proceedings.0 -

Hiya,
Thanks for that. You made me smile, and I needed that!
Do you have experience of this then?
I don't know what I was thinking
It's the being 'done' for fraud, that is my main worry, on top of all the debt.
It's as if, even if I do the 'right thing' here, it will then create a whole host of other problems -
ie - If The Money Shop don't get paid / I go in and tell them the score, they could then take me to court, and find out I lied on the loan application..
OR - even if The Money Shop do get their £500 back (the cheques are honoured by the A&L), the A&L will then be very unhappy that I've written these cheques, knowing that I wouldn't be able to cover them - again, fraud0 -
Sim....Moneyshop WILL NOT take you to court. Unless YOU tell them about your work situation how can they find out?? With data protection they can't just get this information on you anyway! £500 is NOTHING to places like the moneyshop. Remember what I said re: my 15 or so cheques in G/F's name?? I was sure I'd be in trouble with Police but was not the case. Honestly Sim I know you're worried but your debts are small compared to how mine were....you have no big assets such as property so don't worry. A & L will go down the standard debt collection route....letters/phone calls & if no response they'll sell it to debt collecters....SO WHAT???!
Right I'm being bossy now cos I had EXACTLY the same issues & it is NOT worth making yourself ill over.....!!! So please follow my steps below (!!!).
1-Change your telephone number so you are not hassled by calls...(free on landline-just fib & say you've had some nasty calls)...if mobile consider a £10 cheap PAYG for the next few months....
2-Deffo get phone advice from CCCS (CAB are fab but CCCS specialise & it costs NOTHING)...they can help you & either send you a standard template letter to keep companies off your back OR if you enter a free plan with them (even if you decide to do a DRO or bankruptcy)...they can also just double check that DRO is better than Bankruptcy
3-Ask the question on that link I sent you...he's great!
4-DON'T WORRY-even if some debts are sold to debt collection people NO-ONE can come & take away goods, etc...only a bailiff can do that...& even then if they can't get in through an open window/door then they can't come in..
5-Don't whatever you do pay off money-shop-it will be seen as 'preferential treatment'.
6-Debt is NOT A CRIMINAL OFFENCE-BUT A CIVIL ONE-you can't be jailed!
Sim....do not worry....if you have a DRO or bankruptcy once that's been issued the debts are not yours anymore & they must dela with the Official Receiver....!
DO NOT MAKE YOURSELF ILL (OR GET PI**ED!!!)...IT'S ONLY MONEY!!!0 -
Sim...DO NOT pay the moneyshop. It will be seen as preferential treatment....as soon as the DRO is issued they can;t touch you anyway....don't worry re: alliance & leicester....even if the cheques bounce...SO WHAT! It'll all be written off in the DRO & then they can only communicate with the official receiver & NOT YOU.
As I said....follow my steps (I'm SO bossy!) ....I think if you speak to CCCS & also Simon it'll put your mind at rest.
FORGET THE FRAUD THING...IT AIN'T GONNA HAPPEN!
I suggest if your G/F can lend you 500 quid then use it for a short break this weekend or next weekend! Weather is good....do that after you've made all your calls/done my steps (!!!)
Check out haven holidays, park resorts for cracking deals (!) DON'T WORRY!0 -

Thanks clang_uk.
I would love to repay them, BUT, my Girlfriend can't really afford it, so I'm not really in a position to pay them.
Even if I was, I'm not allowed to pay The Money Shop off, according to the CAB, as I would be 'showing preference to one creditor, over another' - thus, my DRO would then be revoked. I really would be scr ewed then
So, the CAB already know about this £500 Money Shop debt, as I've already told them - I wanted to be 101% honest, as I've sailed way too close to the wind for way too long!
It looks like I'll just have to sit this out, and let the Money Shop debt, shift to the A&L account (I hope..)
Thanks again.0 -

Thanks Claire.
I'd love to pay them back, but even if I could, as I'm now going for a DRO, it's not allowed!
Thanks,

The fraud/police thing isn't going to happen, honestly. Please listen. It is impossible for you to go to prison. It just isn't going to happen. Forget that whole worry - you're just wasting time and making a mountain out of nothing.
However, you do need to speak to CCCS who WILL HELP YOU sort everything out and arrange a plan to pay back your creditors.
Speak to the CCCS now. Be honest. Tell them everything. Don't lie. It will be OK. You need to call CCCS and make the move now to sort your debt out and get on the road to financial recovery. It's going to be long.
But DON'T, I REPEAT DON'T go near the bottle! And don't tell the MoneyShop anything they don't need to know. :cool:Just another dumbass with money...0 -

Thanks.
I know I've been over worrying. It's just a bit difficult to see the wood for the trees at the moment.
There's a lot of guilt there too
As the lady at the CAB said, the worst that'll happen, is that the Money Shop debt of £500 will just shift to the A&L bank, and then we can include it in the DRO, once the account is closed.
Thanks for the pointer re CCCS. I would rather stick with the CAB though, as she's taken copies of all my paperwork, and is going to contact my creditors, on my behalf.
She called NPower yesterday re the £635 I owe them, for Electric arrears. Not sure what to do about this one.
NPower want to agree a payment plan (nothing was agreed yesterday) / direct payment from my ESA, but they're wanting £15.30 a WEEK!
If the Electric debt is written off in the DRO, would NPower insist on a prepayment meter?
The meter isn't always accessible (it's in a neighbours' entrance hall), so I really don't want a prepay meter. It's also a lot more expensive.
They only took the prepay meter out in April!
Thanks again,
Sim.
PS - I have no intention of going back to the booze. Am going back to my counsellor next week. 2 weeks sober tomorrow! :j0
