Tax credit overpayment

I went BR on 17 May and included my tax credit overpayment in my BR.
It's only for £121 but it is their fault they overpaid me because I changed bank accounts in June 2009. They then paid me two amounts of tax credits in one week (they have actually done this twice), even though I rang them to say my son was likely to finish full-time education and so my tax credits would stop on 31 August.
I was writing to them to dispute this between September and December but they wasn't having any of it - I had been overpaid, it wasn't their fault and so I have to pay the money back.
I have been reading about tax credits overpayments and it appears to all boil down to the date of the "final decision" letter.
I received my final tax credits decision and the letter is dated 17 May! Will this go in my BR?
Also, I have today received a Notice to Pay from HMRC.
Thanks

I'd speak to your OR - I would think it is probably included but the best person to say either way will be your OR.
If the overpayment was made before your BR date I would be very surprised if it wasn't included.0 -

uh oh! Will I be in trouble? We had our tax credits deducted last year (the year I went BR) totally my fault, when I worked I got backdated pay and didn't think about it effecting my claim. Really stupid I know but definately not underhand.
Erm, anyway. I just thought I had to pay this back with a reduced award i.e. the amount I receive in my bank account is lower than what we would normally be entitled to. So all these BR months I've actually been paying a debt!
