Fredrickson International!!!!

I am new to this website but HAD to join because of the invaluable advice I have gained from just viewing threads, but I need some personal advice now.

I received a letter from them (Fredrickson International) today, stating I owe 'Lowell Financal Limited' £332.53. :eek: Problem is, this debt is 5 years old and I had a mass debt pay-off when I received money in August 2008, whereby all debts I had (and were aware of) were paid off. I wasn't even aware of this debt!

I did the stupid thing of phoning them and asking them what it was for, they couldn't give me a date for the debt and were actually not very pleasant. I simply asked for the date of the debt and he said 'there isn't one' so I replied 'well I'm entitled to know when this debt I supposedly from' when he said 'did you not hear me!?' and a full blown argument occured (I have little patience for nasty people, there's simply no need for it!). :mad:

He even suggested I go to the police about the matter but "you should think long and hard because you will be prosecuted if it's found to be true". On what grounds would I be prosecuted!?

To top this off, I'd only just got off the telephone from a counsellor who has diagnosed me with severe depression and severe anxiety.

I phoned them back after calming down and just set up a direct debit, no questions asked. Just wanted them of my back I suppose. I googled the company and there's scams around about them and allsorts.

Well, I have accessed my credit report through equifax and no such figure is there!? Yes, I have a default on Lowell whatever it was but it's NOT for that amount and is actually considerably lower.

What can i possibly do now!? They have my bank details, my phone number, address. I'm actually so worried about it that it could be a scam. I have 2 children to feed and they don't seem to give 2 hoots.

My theory is that if I leave it another 12 months, it would be a 6 year debt and therefore statute barred. I could bide my time with them by sending letters for confirmation of debt etc.

I'm lost and screwed and everything's going around in my head. I even said to the man 'why do you have to be so nasty!?' 'because I'm a debt collector'. Real pillar of the community ey!?

Sorry for the long post, I just don't know which way to turn. :(

    Hi biggady-bong,

    Sorry to hear you're having trouble with these people(?). If you read through a lot of the posts on here you will find that DCA's in general are not a nice bunch of people to deal with. Firstly never contact them by phone, always communicate in writing only otherwise you get exactly the sort of response that you did and why should you let these lowlife spoil your day by talking to them. If they call you just don't answer the phone.

    If you have no idea what the alledged debt is for then send them a prove-it letter, this can be found on never-in-doubt's unenforceability thread on page 2 post #37 (sorry don't know how to do links). Hopefully they will disappear for a year then it will be statute barred anyway:).

    Stop speaking to these clowns on the phone & refuse to answer security questions if they phone you.
    They are trained in the art of talking bulls*it & will say anything to get a payment out of you.

    As stated don't EVER talk to them on the phone their company is a joke. Send in the suggested template letters recorded delivery to their registered address (not po box) If you can't afford the payments or you got 'bullied' into making payments you cannot afford which they try to do with everyone...To be safe also cancel your cards and order new ones, cancel and standing orders you may have set up to them.

    If they can't give you a date, or who you owe the money from you should have simply told them, you gave no proof i owe the money, or neither will i pay nor a court go in your favour, goodbye :)
    Simply put they must provide proof, i've heard of debt collectors take people to court without sending out proof and it gives you a perfect defence even if they bring proof on the day, no proof was provided so they cant do anything.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
