Discharged from BR and circumstances now changed

Hi

Could someone help me with the following...

My partner and I went BR in January 2009 and have since been discharged. I had to pay some contribution towards my debts and have continued to do so however i have just had a baby in March and of course I am now on maternity pay and soon statutory pay which will need i will not be able to afford to pay this so i will write to them to explain my change of circumstances however could they then ask for our family outgoings as my partner is now working (he wasn't at the time of BR but did inform them once he was but they never asked for anything from him - i guess they were too busy!) what i don't want to happen is for them to start fishing again and then my partner has to start paying - can this been done since we have been discharged???

any advice would be greatly appreciated

    My understanding is that if your parter was discharged without and IPA/IPO one cant not be enforce after discharge.

    So if you advised them when he was working and they did nothing with it them he will be fine.

    Having said that i assume now he's working, his contribution to the household income will have gone up.

    My advise is just be honest, if you cant afford to pay the IPA, then the OR's calculation should reflect this when they recalculate your SOA. If your squirrelling away £1000 a month and thats why you cant afford it, then this is different.

    The same as your BR SOA - you will list your income and the household outgoings plus your OHs contribution to these outgoings, which is NOT the same as your OHs income.

    As your only income is very low, then its unlikely your IPA will continue; they are very flexible. Your OH cannot have an IPA implemented on himself if he was discharged without one.
