I had been 'hassled' by Black Horse, with post emanating from up to six different addresses, all carrying the same computer generated signature (that of their UK Operations Director). I wrote a letter to the address which I thought I had been dealing with, only to find that it was completely ignored.
The only way I got a response was to copy my letter to their registered UK office, and every other address from which they had written to me. A bit pricey on stamps, but I did, finally, get an acknowledgement.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi There,
The one I've used and had a response from is
Capital One Card Services
P.O. Box 5283
Nottingham
NG2 3YJ
They will usually send a 'We have received your communication and looking into it...' letter in about seven days after they receive it... they should get back to you within a few weeks from what I remember though.
Good luck!£2 Coin Savings = £0.23

I did mine with Cap one. Started in about May with the DPA request. Sent my two snotty letters and launched my court papers at the end of July.
Got a full refund agreed last week of £521. Waiting for the cheque now before I halt the MCOL stuff.
Definitely, definitely do it. I cannot urge people any more to do it. All it took was a few hours reading, two snotty letters (from a template) and Bingo!0 -

Haha! That's a story! They've 'refunded' me £96 to the account, however as it's been passed to a DCA I have no way of accessing the money! I've replied to them stating this, and also claiming further charges and I've accumulated more than £96. I sent my second letter last week so fingers crossed I'll get something soon. Keep us posted & good luck!:beer:terriblesaver wrote:Thanks L T D - how far have you got with it????

See, to be fair my Capital One card going to a DCA wasn't all that bad... it froze interest on the card (I'd spent around £2k, but it escalated to £2,400 with interest & late payments etc). This way I can negotiate with the DCA through Payplan whist reclaiming my charges back from Capital One...£2 Coin Savings = £0.23

You don't have to - if any of the balance they are trying to collect on is made up of charges you can dispute the debt, get them to send it back to Cap one and then dispute the charges with Cap one - the result is that you might get the charges knocked off the balance before you pay it back and hey presto - you've reduced the balance.
From a MSE point of view that makes more sense to me. Its your money, don't give it to them then argue to get it back!0 -

There's no need for it to. You don't have to go to court and although Cap one will say they will defend it, they won't. All you need to do is fill in the form online and submit it. And for an MSE forum poster that should be pretty straight forward. For small claims there is no reason at all for you to appear in court, you can leave the court to it
Think of it as it being just the same as coming on here for a rant! There's no difference, just find the wording, set up the account (like an MSE registration for a username and login) then copy and paste and it's all done.
And no, none of them have gone to court yet as once they have and one loses, there is a legal precedent set that everyone will fight against, so the chances of you being the first are like a bazillion to one.0
