Repossession, Bankruptcy and CRFs

Hi, I love the forum and read and learn lots from it :j

My story and question...

I went bankrupt in Feb 2009 and was ED in July 2009 (I know 5 months!). My OR knew I was in arrears with my mortgage but the mortgage company didn't formally repossess my house until June 2009 (voluntary in the end). In fact the main reason I had to go bankrupt was because of the huge shortfall that would remain once the mortgage company had sold the house and then there was the second mortgage with another company too. (I did try for 12 months to keep up with the mortgage and sell the house but no one went near it and the house next door went up for half what I had mine up for!!). Anyway the house finally sold for nearly nothing in Feb 2010 and I have looked at my CRFs and the mortgage account is defaulted as of the repossession date (June 2009) and has a huge balance left (£58K!) and the repossession entry has the balance left as unsatisfied.

As the balance left is included in my bankruptcy of Feb 2009 should the account say satisfied/part satisfied and the default date be the same as my bankruptcy?

Please help as I am not sure and I hope someone knows the best way to sort it.

    When the mortgage company sent you the forms for the repo did you sign them?

  • Hi Curly,

    The mortgage company didn't send me any repo forms. I had already sent a letter for voluntary repossession with the keys before I went bankruptcy it took another seven months to allow it to go through due to the other account holder not communicating anything to the mortgage company.
