An Enquiry re: Mortgage

Hi.

I am inquiring about an issue a relative of mine has....

She took out a mortgage with a chap she was in a relationship with, sadly that fell apart and now she is trying t cope with a mortgage on her own.

The Mortgage provider will not remove him from the mortgage even though he has not paid or provided anything toward it for some time...

My relative wishes to take the mortgage on on her own but she isn't quite able at this time, she has spoken to her ex partner who has said he is willing to forego any part in the mortgage and any subsequent sale and profits.....

Her solicitor has offered to draft an agreement that is not legally binding but may help, should he again renege on his word and chase future profit (should there be any)....but my question is could she draft an agreement herself, or a knowledgeable person do so on her behalf thus saving the money?

it seems daft to pay a solicitor to do this, seeing that they have said any resulting document would not be legally binding anyway, but would help her case should it go to court....

Any and all advice appreciated...

    If the agreement is unenforcable then little point in drafting it.........

    I assume that your relative does not meet the criteria to apply for a mortgage in her own right. In such circumstances selling the property is the most pragmatic solution. As there is a high probability that she will default at some point hence lenders reluctance to lend.
