What is the minimum amount a debt collection agency would file a CCJ against you?

    Shouldn't the CCJ be put on your credit record after being found "guilty" so to speak.. can they just whack it on there as soon as they go through the county courts whilst awaiting an outcome? it has to go through court first, you would get court papers which you would need to complete either admitting or denying the claim. If you admit it goes through, if you deny then you can ask for it to be moved to your local court and turn up to defend.

    So really I am gambling with the court fee's added on to my debt of £550 and any interest charged. Maybe it would cost me another £100 odd pounds if they do decide to CCJ me is it worth it me holding out for the sake of it to see if they progress? Are you not intending to pay them anything if they don't take you to court? I would say if you agree you owe it and can afford to pay, then arrange payment - you could for example offer a reduced F&F settlement (in which case you could save yourself quite a bit more than just the court fees)

    And just to clarify as long as I settle within 14 days once a CCJ has been issued - I can get the CCJ removed from any of my records including credit report? Is that correct? yes

    Also in the mean time to cover myself is it worth me sending the following letter to freeze any interest etc added to my loan as the DCA have sent me no evidence or written (signed) contracts that I owe them money.

    not sure about the letter - have you actually asked them to provide you with proof of the debt in the past? or formally disputed that you owe it? or done a CCA request?

    Just to clarify, you have 14 days from receiving the court papers (delivered by Recorded post) to defend or admit you owe the money.
    You have up to 1 month to pay the outstanding balance.
    Unless you pay the full amount of the judgment within one month, your CCJ will be recorded on the Register of County Court Judgments for six years.

    Sorry I was wrong here... I have just checked this out on the direct.gov website and it states;
    'If you pay the amount outstanding, you can avoid a judgment being made against you.'

    So the CCJ is only added on your credit file if you do not pay within 1 month. :)

    I have never asked for any proof of the debt in the past or done a CCA request? What does CCA stand for? I don't dispute that I owe these guys money - but I think they added various charges on to my balance which may deem unfair?

    Send the CCA request.
    They have 14 days to produce a copy of the credit agreement.

    The debt is about two years old now! Thanks I'll send them a letter and request a copy of my credit agreement etc.

    In that case not sure how much use the cca request is, as the rules changed in 2007(ish I think). Have a read on the above anyway.

    Its not normal at all anyone can file a claim online and if its not paid , instruct the courts to follow it through

    I agree it is not normal, but that was a quote from an insolvency website, not by the poster themselves..... ;)
