Money Owed from Employer

Hello Guys,

I am having a bit of trouble with my exemployer who is just refusing to pay. I have followed all the stages up to the employment tribunal and his 42 days have passed to pay.

This is just as simple as him not paying for no reason. He never turned up to any tribunals or gave any response.

I was just really looking for advice to make sure I get the money owed.

    How much are you owed? If it is over £750 you could threaten him with bankruptcy, that might grab his attention!

    He owes me just over £1,000.

    Could you let me know how I would go about that as I am new to all this?

    It would cost you approx £1,000 to make him bankrupt, so it's not the best option.

    Can you speak to the tribunal people for advice on what to do next?

    Yeah, they told me to go to see a sheriff officer but they also said they are rarely successful.
  • Exact same situation as this for me. Have been awarded a default judgement and the 42 days has passed. I'm now looking into the use of Sheriff Officers to collect the debt, but I'm afraid that my old employer is used to playing the system and I will never see the money.

    Maybe XB-CDD could let me know how things turned out?

    The easiest way is to go for an employment tribunal, then once the judgement is done they have a certain time to pay. If they don't pay get it changed to a CCJ, then you have all options open to you - at the same time you earn 8% interest. The risk you have they go bust, so this way I believe is the cheapest from your point of view.
  • Same happened to me, I won a tribunal by default as he didn't bother to contest. Over £2,500 but never saw a penny. Saw a solicitor for one of those free 20 minute appointments only to be told theres pretty much nothing that can be done as I know he already had bailiffs on his back so adding mine would not make any difference and they would most likely turn round and say they could not recover the debt. Also, he has CCJs coming out of his ears, used to ask his staff to take out credit for him as he was unable to get any. Made me so angry at the time but I've had to write it off as a bad debt, even though its ridiculous that nothing much can be done. Good luck x

    But it costs very little to get a CCJ especially if you are unemployed (hence don't pay fees), so even if everything did come right you would get paid.

    With my case, I didn't think I would get anything but was unemployed so had time on my hands. So I went down this route, and ended up with an 'oral examination' thinking the court would force him to answer questions - how naive was I, 'don't know' seems to be a good enough answer. I then got a solicitor involved, which cost me £1.5k in the end - didn't really achieve much apart from token payments.

    However eventually he managed to sell the product the company developed, and I got all my money plus interest. I still had to pay the solicitors fees, and in hindsight I got them involved because I was angry at the 'oral examination'. The reality was that if I didn't involve the solicitor, I would have still got my cash because of the CCJ outstanding. There's a lot more to this story, taking about 2 years, but I eventually got my money so it was worth the initial efforts by me.
