My 100th Post - Help needed muchly! - Useless!

I posted (Head & Brick wall title) a few days back regarding Halifax taking £200 out of my account. I've managed to get an appointment with my bank manager tomorrow about this as I need the money refunding. I've C&P'd my original message:
Argh! I've recently opened my new basic account with A&L as advised as I owe a lot to Halifax (Loan and 2 credit cards). So I got up early this morning, went to transfer my mortgage money accross to a different account and then take all my money from the Halifax account as I was paid yesterday.
However, as I haven't paid my loan for a while I'd accumulated £600 of arrears, however I've offered token payments and Halifax are aware of my Payplan situation. Still they wouldn't let me have any access to my money until I had paid - they said the minimum was £200. I told them I have £350 - £400 for mortgage/bills, £70 car insurance, £90 car tax, food, £150 petrol per month, phone bill, money that I owe Mum, and that I'd booked a holiday a long long time ago and that I need a bit for this.
I was really really nice to the girl and so was she at first, then she just got really really arsey and started saying things like 'After your mortgage your loan is more important than anything, I don't thing I'm being harsh taking £200, as you owe £5k, I could take all £600 now if I wanted'.
I expained my situation and that I intend to pay my debts but that I just needed time & to pay other things. And that if I couldn't access money to pay my mortgage then it would make things worse.
I was left with the only option to pay £200 - I did warn her however that if this financially compromises me any way this month then I will be writing cheques and that if Halifax dare charge me for bounced ones then I'd reclaim all charges - and she literally laughed at me.
I'm fuming - and to top it all off I got a parking fine due to how long I was in the bank for.
I'm angry, upset, annoyed - all I want to do is get straight yet there's always obsticles in my way. I'd rather them take me to court - if they start messing me around they'll get a damn sight less than what I'm offering them now. I just feel everything is against me at the moment. This was going to be my last month before I start making payments to Payplan.
Sorry about the moan, I'm usually cheerful, but this morning has really really got to me. Is there anything I can do??
Now I have the appointment I wonder if there's anything I should or shouldn't say. Any legal bits and bobs? Has anyone been in this situation before at all?? Many thanks for any suggestions

i thought you were gonna try and take money out and then when they charged you claim the charges???!!!

That was the original idea I took out £300 on Saturday, but completely forgot about it on Sunday and Monday!
My other idea was that if they wouldn't refund the money then I'd tell them that I'm gonna put a brick through their windows - I won't get my £200 back, but it will still cost them £200!! Hehe!!
Rubbish, I guess I'll just try the charm thing and be nice. I'm sure they can't financially compromise you of things that you need, so if I give them a breakdown;
Mortgage £350
Car Tax £180 (I'll tell them that I get 1yr car tax as it works slightly cheaper)
Petrol £180 which is untrue, but they don't know that
Mobile £35 on contract so this will automatically come out
£67 car insurance
£100 food
Then I'll say that I owe my Mum and other creditors money or something... that should do it!£2 Coin Savings = £0.230 -
Unfortunately the only legal standpoint you have is if you have the payplan agreement in writing with them. they have the right to take the money as they have left you the money to pay your mortgage and enough to live on. what you may think as second most important the law doesnt. :rolleyes: other than that all you can do is stay calm and try to explain the situation, there are good and bad people that work in banks as there is in every walk of life, and the person you speak to maybe very understanding. just explain that they are making your situation worse as you are getting further in debt with other companies through their charges and the more that this happens the less money there will be available to share out. tell them you will not have enough money for petrol to get to work. etc. write out a budget that shows you are struggling with what they have left you, (think there is one on here)the essentials come first holiday money will be smerked at. do not mention claiming back charges, it will only endeavour to get them on the defensive. if however you have no success then tell them what you feel as you walk out
bottom line is just appeal to their good nature if they have one.

Absolutely useless. Told them the truth, that I have mortgage, bills, car tax, car insurance, phonebill, petrol & food to buy but they were having none of it.
They said that with my overdraft of £200 that I could afford to pay the £200, even after I made it clear that I wanted to pay off my overdraft this month as I'm changing banks so they can't do this again.
Guy in the bank was useless, absolutely useless, just stuck me on the phone to an agent. Told them the whole Payplan thing, how it's going to financially compromise me this month so they won't receive anything from Payplan next month. Told them that I now intend to close the account ASAP and that my salary will go into a different bank and that as they've messed me around I'll mess them around and repay my overdraft at the rate of £1 per month.
Bank fella was like 'You have to be careful as you have a mortgage they can come round your house'
I pointed out that by law I don't have to let them in and that I've read up a lot on consumer rights etc etc
Then he goes 'Yeah but they can take you to court to gain entrance'
Ggggrrrrrr. I was sooo close to sticking a lightbulb in his eye.
Avoid Halifax! Now I'm going full steam ahead to reclaim all my charges.
On the funny side, I took the CSA's name, Steve Scallion... I was like 'Oh, Scallion..., scallion as in the onion??' (Really sarcastically).

This may not be much help but have you asked Payplan if you can pay a lower sum for month only, just to make up for your problems this month.
I had to ask for some money back on my first month as my new bank was unable to stop a couple of direct debits to my creditors being paid twice.0 -

Yeah I'll certainly do that, my repayments are £130 per month, so I'll offer £60 next month and then we'll get the ball rolling properly from October onwards... I'm even more determined now to pay my debts off though... 5 year plan, I'll do it in 2.5 easily!!! :beer:£2 Coin Savings = £0.230
