Three years ago I took out a loan to consolodate a few debts including a car loan, and for home conversion with Black Horthe cheque had been cashed. I requested copies of the cheques se.
About a month later I was contacted by the car loan company chasing for payment, I told them the f & f settlement had been posted to them, they stated not received. I then rang Black Horse who stated that the cheques had been cashed, I then requested copies of the cheques to assist the payee in reconciling the cheques to the right account.
Unfortunately at this time I became ill so chasing around after the bank wan't an option, I was paying both the loan and the car loan.
Six weeks ago I received both cheques in the post, uncashed nad never been through the banking system, Black Horse have accepted that the cheques were never cashed. however now we get to an impasse.
I have requested that the repayment of the cheques be made payable to my wife, Black Horse have stated that they can only reissue the cheques in the name of the original payee. Unfortunately the original lender went bust 2 years ago and instead of the £5,500 I did owe I only owe £700.
My request is what can I realistically claim against Black Horse and how to I get to communicate to the complaints department as there is no contact number and even the people in collections can only communicate to them by e-mail. (I have already written a letter of complaint that they received Saturday morning).
Thanks in advance
Stephen

I'd claim back all the money they should have paid out via the cheques, plus the interest that had accured over the years!

Thanks, I am requesting interest deducted off the outstanding amount, accrued interest on the amount that has been sat in their account since 2007, and the money paid back.
The problem I have is they only want to pay it to the original payee who do not exist, and I cannot talk to the department to explain why I want it paid in my wife's name.
I was also wondering if I was entitled to any compensation as for 3 years I have been paying £170 a month more than I should have due to their mistake and have had to pay back more to the loan compane as obviously the f & f amount was a lot less than I am paying back.
More importantly does anyone have a number I can contact someone higher up than the (admittedly helpful but unfortunately impotent) collections department.
Thank you again.0 -

Thanks, unfortunately it now gives a different number for me to ring, which appears to be motor insurance.
How difficult can it be to talk to or to get an e-mail address for one of the main loan companies in the UK apart from the collections department.0
