Hi There.

New to this so pls bear with me.:D

A number of years ago i got into debt. I was young at the time and nieve. I got into such a state that basically i ran from where i was living. one of the debts was with a major high street Bank for around 5k. Anyways time passed etc and my life moved on. Of course the debts never left my mind but for some reason the banks never caught up with me. I contacted The National Debtline who sent me some info reguarding debt. Within this info is the Limitation Act which for those of you that don't know set out the rules on how long a creditor has to act against you. My debts were unsecured at the time as i was either living with parents or later on in a rented flat with an ex-ex girlfriend. Now it says in the info that you can argue the limmitation act if the creditor has not obtained a judgement against you and you or anyone else owing the money have not made a payment on the debt in the last six years and you have not written to the creditor admitting you owe the debt in the last six years.

Out of the blue the phone rang the other day, i picked it up and it was the few seconds delay thing untill they talk to you. Thing is it cut off straight away before a word was said. I dialed 1471 and it was a message from a bank saying that they tried to call etc and not to worry as the call wasn't important and would call back again. I am wondering if this would be the section of the bank that would deal with chasing up loans etc or if it's the ad dept trying to sell stuff.?. Do any of you know..?. Also have any of you gone through the use of the limitation act and what was your experience..?. I am sure it was over 6 years ago since i last had contact and made any sort of payment. Infact by now i would have thought that they would have passed it onto a collection agency..?.

Any advice is appreciated.

You should get a copy of your experian and equifax credit reports and see what is on there. If the debts were within a six year period, then they would still be on there

(I think debts cleared or uncleared remain on there for six years from the last activity and searches remain for two years, but my figures could be off, as it's a while since I looked at my own report).

That at least will give you an idea of any timescales that you are dealing with.

Because by then you've blown your chances. That's it."
