Can They Do This?

I was due to start work on 4th June but unfortunately I was in hospital. They have now said that they will have to let me go as they need someone immediately. Can they do this?

    Yes.

    To be honest they've done the right thing. If someone didn't show on their first day with me they'd be told to not bother again.

    Depends if you have a signed contract for permanent employment and if you followed the correct procedure for informing them you couldn't start.

    No it doesn't.

    She's been there less than 12 months and has very few rights. I don't know off the top of my head, but at best they will owe you 1 week notice.

    Not sure why OP is confused. Company needed someone to work from 4th June. OP didn't work from 4th June, there OP is no good to them. Why should she be paid anyway?

    If it was an unplanned trip to hospital and the problem wasn't likely to continue for more than a week or so then you are better off not working for such an employer! It might be legally right to ditch someone but it shows a level of moral behaviour well below that of a reasonable person. Get better. Find a better job :)

    Really sorry to hear this rbk. Was your stay to do with your long term condition, and how long past your start date were you unavailable for? If so, you may have some protection under the DDA, irrespective of having been their for less than a year.

    Sorry to here this RBK. I was wondering how you were as I hadn't noticed you posting for a while. Did you declare the condition? If so then you may have some rights as dmg says. Get some advice x

    Edited: depending on the reasons as to why someone was of, if it was a long term thing then I would not be happy and if I were an employer I would be looking to dismiss the person asap, if however it was a one of Hospital appointment for 3-4 days I would look to postpone the starting date by a week and proceed from there but I would be keeping an eye on how many days the person had of during the trial period and upto the year mark.

    As I said I feel for the OP but also it is unfair on a company that may need someone straight away.
