P45 and P60

I am in a situation where my ex-employer (a small size local company which I have worked for 2yrs) is not providing me P45 and P60 form.

I took a career break 3 months ago to do travelling. After a month long travel, I was back and did not see the forms coming through my post. I have been following up with my ex-employer. I have called, text and email. It is 3 months now, I am still awaiting for my p45 and p60.

It is becoming urgent now as I need to start looking for job and those are the forms that I need to present.

Can anyone please advise me what options I have since contacting my ex-employer is going nowhere.

    If you left 3 months ago, you won't get a P60. P60 are only issued to employees employed on 05 April.

    You need neither a P45 nor P60 to serach for work. If you don't have a P45, ask your new employer when you secure new employment for a P46.

    Premier is correct. A P45 from the last tax year will be of not help to you this year.
    I assume you are trying to reclim the tax overpaid for 09/10 (assuming you did not work abroad). You need to download a form P85 from www.hmrc.gov.uk and send it to your tax office with a note to say that your employer is refusing to give you a P45. They will take it from there.

    I used to do Payroll as my job and I would like to clarify matters. If you were employed on 5.4.10 by this employer then you are legally entitled to a P60 by 31st May 2010. If you subsequently left after 5.4.10 then you are entitled to a P45 also. You need the P45 to sign on or when you get a new job and you nee the P60 to prove what tax you paid 2009/2010. A P60 can only be issued once and you cannot get a copy so important you get it.
    I have lost count of the number of times I had to do a P46 for a new employee because they had no P45 from a previous employer and they then had to pay emergency tax until the tax office worked out a new code. It is basic Payroll procedure to produce a P45 and P60 and you have every right to insist on both of the timeline is as above.
    I am presently helping my daughter with precisely the same problem.
