How to break legal deadlock of solicitors time wasting.

Hello,

I have a legal stalemate situation and I need to deal with it before I go insane.

Basically, it is a disputed builder's claim that he is owed more money than I have paid. For about 2.5 years, this has been dragging on. My solicitor arranged for 3 claim assessors (the claimant's, my personal assessor and an independent) to visit and do assessments (never!) However, they can't seem to decide how much the work is fairly worth and seem to be deadlocking somehow for their benefit (possibly).

My solicitor is asking for an extension on the current case for some reason. The builder has been threatening to take this to court for nearly 2 years now but it has not happened. Every time I phone my solicitor, the secretary just states that he is busy. Therefore, I think that I may need to shake things up a bit. Are there specialists that can legally, metaphorically smash their way through the stalemate and try to get a decision on what the hell is going on here? I would certainly be interested in hearing others' opinions/experiences on this sort of matter. I do have enough money to go to court etc but I am waiting..........

I also cannot legally do anything to the house, even though it is in a state of bad repair due to the builder (it has to be left in the original state).. I can't sell the place and move even if I wanted to.

Please advise.

  • Why don't you go to another solicitors and get a second opinion on the case. You can get a free consultation. Over 2 years seems a long time to have been waiting, they could advise you on how to get the case resolved. Good luck.
