Transfer of Title with Negative equity & ex in trust deed!!!!

Hi,

I am looking to see if anyone can help. I bought my house with my ex partner 5 years ago and paid way over the odds for it. Almost as soon as we moved in, we split up. He only helped with the first months mortgage. Now he has entered into a trust deed and I am trying to get the house transferred into mine and my husbands name. (got married last month). The mortgage company have agreed to have it transferred but the company who have the trust for my ex are looking for £500 'standard negative equity fee' before they will agree to the transfer. I don't have that kind of money to give to them and really i feel he isn't entitled to it, I have paid the mortgage for the last 5 years and he hasn't gave me a penny for our child. Is this a standard fee? Is there any way I can get round having to give them any money?

Hope someone can help

Sorry, but don't understand the trust deed side of things, what exactly has he done, why would a company hold a trust for him?

  • When we split up he ran up lots of debt and decided to look into going bankrupt on terrible advice from his dad. He says he forgot his name was still on the mortgage!!!
Before applying for bankruptcy he was adviced to take out a trust deed. Due to this he does not have control of his finances and the company that hold the trust deed have the final say on whether his name can come off the mortgage or not. Hope I have explained it a bit better.
