Employer not paying tax

I have been working as a delivery driver for a small business for two years, In november another business took over the deliverys and took me on doing exactly the same job. I have recently discovered my new employer has not been paying my paye tax, although he has been deducting it and not giving me any pay slips. Also the tax code is incorrect (and has been for two years) it is 563L and hmrc have confirmed it should be 647L. So not only has my employer not been paying my tax he has also been over taxing me ! Because i have no proof of how much tax my employer has been deducting, have i lost the tax he has been over deducting? or can i still get a rebate from hmrc even though he hasnt been paying them? What do i do next?

How do you know he is operating the code number he is - you must have some proof of this - I assume the net amout you are receiving is similar to what you were receiving weith your previous employer. Your tax and NIC are your employer's liability not yours. You are due a refund even if he has not paid the tax over. HMRC would eal with your refund and then chase him for the tax.

I get paid exactly the same now with my current employer. So i assume he is using the same code as my previous employer. So my previous employer was also using the wrong tax code but paying everything they deducted to hmrc. My concern is i have no proof that my current employer is using the wrong tax code. He could claim he was using the correct tax code and i would loose the extra tax i have been paying.0

How do you know what tax code the employer is using for you?
How do you know the employer is deducting tax & NI from your salary?
How do you know how much the employer has deducted?
How do you know the employer is not making PAYE payments to HMRC ?
(HMRC are very quick chasing late/missing PAYE payments from employers)

You have the right to a written pay advice which will detail all but the answer to my last question.

You dont need proof of the code number he is using. he has to make returns to HMRC of the pay and tax deducted each year. If he fails to do this, once you have contacted HMRC, then they will chase after him for the information to enable them to make your refund. Ask him for your P60. It will detail the tax & N.I. deducted in 2009-10 tax year and will state the tax code used.
