Wescot

I have been receiving letters from Wescot stating I have a debt with Barclays Bank for the amount of £178.77.
I have no acc with Barclays and havn't since I was a teenager, I am now 44.
I have never acknowledged these letters, just thrown them in the bin.
But my credit rating is now been affected and it is starting to annoy me.
To give you some background, I left the Uk in 2002 and moved back in 2008.
I started to receive these letters soon after I arrived back in the Uk.
As I said earlier I just threw the letters away because I felt they must have the wrong person. I did ring Barclays once and said that this was happening and the account wasn't mine, they said I had to put it in writing, which I didn't do. I did not give Barclays my name or any contact details.
A year after I moved back, I bought a house and moved again. The letters have started again to this address.
I'm not sure what I'm meant to do to stop these letters, I'm not very clued up on all the legal stuff.
So if anyone can give me advice, it will be much appreciated.
Thank you

There will be others with better advice, but you could send a "prove it" letter. There's a template somewhere on here.

Hope you get it sorted :)

Have you checked your credit file? Is this debt appearing there?

You need to check this as a debt that you have not acknowledged in writing or by making payments to for 6 years may be statute barred. I believe however that leaving the country stops the statute barred clock and it only restarts when you return.

Thanks for the replies so far. Yes the debt is appearing on my credit file.
I lived in another european country for those 6 yrs I was away, don't know if that makes a difference.

The letters always say they will take further action, they have not. Other than send more letters saying the same as above, which makes me believe they know they can't do anything with the debt!!
    Would you agree?

I don't believe the debt is mine as I have no account with Barclays. So is there something I can say to inform them this is not my debt.
I'm worried about contacting them, because then I have acknowledged the person they are writing to is me.

    So confused!!!

    Hiya

Send this to Wescot: You know nothing of the Debt / Prove It

If they continue to annoy you then complain to the FOS about it.

Yup, as Fermi says, you should send the prove it letter. This is not acknowledging the debt or even saying that the debt is yours. Just make sure not to sign the letter.

Even if they do come back with something proving that the account is yours, it sounds as though the debt is statute barred. Has a default been put on the account? Sometimes DCA's will put the default date as the date they take on the account - this is incorrect and a breach of the Data Protection Act. Same applies if it is not your account.

I would put in a complaint to Barclays and make it quite clear that this is not your debt and that you wish to have any defaults on your credit file removed asap and that if they don't you will report them for filing incorrect info on your credit record.
