Wescot Full & Final ?

I have a debt of £611.74 with Wescot (Debt is around 10 years old and I was paying £1 per month), I have written to them with a offer of £152.93 in Full and Final settlement. They have accepted the £152.93 in settlement of the account but state that they do not have to accept the payment it in F&F settlement and they are unable to do so anyway as they are not the creditor, but will accept it in settlement of the account ?.

So a bit confused as I dont want them accepting the £152.93 and then selling it on to someone else for the balance !. So could I send the cheque on the understanding that this is in F&F settlement and that the debt cannot be collected by them or anyone else and by accepting the payment they have deemed to have accepted this.

Thanks.

i think i have read that doing that won't stand up in court.

    i wouldn't risk it.

what does the actual wording of their letter say?

Typical behaviour from them really - their greed will be their downfall.
Have you sent them a CCA request to see if they have the right to collect on this debt?
If the debt is 10 years old - then its prob stat barred anyway.

Not if OP has been paying £1 every month to Wescot - it needs 6 years of no contact/payments/admission of debt

Now today I get a letter from Wescot for £794 telling me that I promised to pay in full by the 8th Feb and I have not so I need to pay within 7 days !, now I have no recent debits (Last had a debt problem 8+ years ago) so it can't be that, so I am wondering if this search by the Tracing Company and now this letter are connected ?.

I just need to correct you there with due respect - just "contacting" someone over a debt thats gone over 6 years does not un stat barr that debt - the debtor needs to acknowledge the debt in writing ;)

This is assuming it is a credit debt, and not a phone bill/utility bill/etc.

If you pay them £152.93 without them putting in writing they accept this payment as full and finall then they will take your payment and sell the remainder to another dca be warned

The simple truth is...Lowells have no legal authority to any money off you - only a county court does, so you shouldnt have been paying them anything in the 1st place.
If you wanted to then fine (before anyone has ago at me) - but i personally would have told them to get lost...
