Hi Jinny
I did see the last message (sorry) but I get bogged down and forget to go back and reply
Your son will be gutted, we usually thrash 1st division teams, even those that have just been promoted so expect a sad son when the migh of the scottish comes tumbling down on the magpoo's (hehe)... i'd predict a 4-0 arsey-whooping myself, maybe more
Tell him that the Blue Nose Bigot from MSE advises him to start supporting a real club :rotfl: :rotfl:2010 - year of the troll

Are we all going to join in this - or do we just have to watch?"What does not kill me makes me stronger". Frederich Nietzsche, 1844-1900.0 -
I think you know how much I appreciate all this hard work on my behalf - and I realise that this particular one has been something of a challenge!
Hope you liked Ann, at the end of the day it is a kinda thanks, but no thanks kinda letter. Point is, you've said within it that you welcome them bringing action against you, otherwise stay away.
I'd suspect they will now issue a court order or walk away. If they issue an order, we'll fight that for you and see what develops - don't be worrying, it is unenforceable and so long as that remains the case, you will not lose. And do not worry about any court order, we'll sort that for you.2010 - year of the troll

Thanks Niddy,
I loved it! Especially as you originally thought it was going to be enforceable! Have posted it off and I will be waiting the post with great interest!
Regarding any potential court order - how long do they give me to reply to a court order? Just thinking about the fact that I am away for nearly 3 weeks and I don't want any court order to be issued in my absene and they think I have ignored it! I go in just over 2 weeks time, so they have got to get a move on!
And I am not panicking, just thinking ahead!"What does not kill me makes me stronger". Frederich Nietzsche, 1844-1900.0 -

Hi Ann
As I quoted in the reply, you can see their errors - they made quite a few, nonemoreso than their claim that for a debt to be unenforceable it needs to be unsigned - really? Well i've just helped them cos it bloody doesn't you know :rotfl: :rotfl:
Anyway, regards to court order - you will not get one - i'm saying it is one of two things they will do, you'll probably get a standard response saying they do not agree with you, to which you ignore them - then maybe in a month or two when you flash up again, they may instruct a 3rd party DCA to which we get rid of them, forcing it back to Amex and the cycle continues - basically it is up to them to take this to court - if they do, i'll be by your side so worry not2010 - year of the troll

Bless you, Niddy.
You are indeed an angel!
Just getting ahead of myself - and preparing for the worst-case scenario.
And I amazed at how much stronger I have become - just because I know you are there advising and fighting on my behalf :A:A"What does not kill me makes me stronger". Frederich Nietzsche, 1844-1900.0 -

Thing is this is helping a lot of people, for instance there are still a few that have not decided whether to proceed as yet, they read all my threads etc but still won't make the jump - so hopefully the knowledge gained from all will serve to create a better MSE long term, cos instead of relying on people like tixy, me, george, ras, fermi that understand the inner workings of the CCA - you'll find we'll all collectively know little bits meaning eventually old Niddy boy can set off into the sunset!
I plan on creating a default removal thread shortly which will explain how to spot defective defaults and how to get them removed, that will end the life cycle of unenforceability and then i'm outta ere!
I do think there are plenty of people here who now have enough knowledge to continue this, even when laws change it doesn't affect things that much - unless they dispel all of s.127 which just aint gonna happen!2010 - year of the troll
