Fieldcall been to house

Hiya, well I knew it was bound to happen at some point. The phone has gone eerily quiet and today the inevitable happenned. A bloke came to the door asking if this was *house name* and if *husband* was in. I said he was at work and he said 'no worries, I will write him a note and post it through'. I knew exactly who he was but acted dumb.

So 2 mins later the letter is pushed through saying that he needs my DH to contact Egg to discuss arrears and to prevent a further visit from him to phone him and tell him when this has been done. It then says 'If I do not hear from you I will attempt to visit again within the next few days'.

Obviously we won't be contacting Egg as intend to go bankrupt as soon as the money has been raised. I know he has no rights and the good thing he wants to speak to my DH who won't be here anyway as works v.long hours but what do I say to him? Do I just ignore the door?

Although this is for my DH, my debts (inc Egg) are as outstanding and as much so I expect the same caller to come looking for me too. Is there anything I can do to stop them hassling me? I have three under 5s with me at home and do not want anything to upset them.

Any advice, as ever, is greatly welcomed xx

Hi jedi82, Have your husband send this letter Fermi has written Re: Threatened with a doorstep visit. Amend the letter seeing you have had one already x

    Dear Sirs,

    Ref: XXXXXXXX

Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date.

Furthermore, should it be your intention to arrange a “doorstep visit”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    Yours faithfully,

    Yep send that letter

    or

Next time he comes tell him your husband has just popped to the shop and will be back in 30 minutes.

Hopefully he waits, or comes back in 30 minutes

When he does pretend to ring your husband and tell him he stuck in a traffic jam and will be back in 30 minutes

then that he has had a minor accident and will be back in 30 minutes, just swapping insurance details.

next time, the other guy called the police, they have just arrived are sorting things out, 30 minutes

thought it best to get himself checked out at the doctors, 30 minutes

on the way back, forgot the milk, 30 minutes

if the guy is still there after that, hand him a copy of the letter personally

Thanks ifwisheswerehorses and dojoman. I will print a couple of copies of the letter, not sign it and have it ready for when they next show up. I will send a copy to their business address too and send it registered.

And thanks debtinfo you gave me the best laugh and even better here you cannot park and need pay and display so it would cost him money too, pmsl.

Hi, just wanted to give a quick update. I sent the above letter by recorded delivery and today we received a letter from Egg stating that they are dealing with my 'complaint' and can confirm that they will only contact me by post in the near future.

So, thank you all very much for getting them off our backs for a bit and roll on next month when we have the fees to actually go br!

    Fantastic Jedi!!

Like Frank we found Egg to be one of the better ones, as soon as we told them about the BR they left us alone. Although they were a pain before then lol!!
