Just hoping for advice.
i am the partner of nrp of two boys aged 16 and 18. My husband has paid CSA for his two children for the last 15 years (as he should.) Just over two months ago the 16 year old came to live with us due to problems at home,as we did not know how long this was going to be for, arrangements were made between my husband and the boys mum for him to keep paying CSA to her as normal and for her to hand back half. Over the last two months none of this money has been given back. We are now paying CSA to my husbands ex for a child that is actually living with us and a 18 year old who is not sure if he is going back to college and as we have found out only spends one or two nights a week with pwc.
After a phone call to Csa we were informed the pwc would have to notify them of the situation, she has so far made no effort to do this,
Should my husband half his payment or stop paying altogether?
Would appreciate advice on this

And you could also be receiving the child benefit for this child.
Does the (now) NRP also claim tax credits?

What your husband could now do is put in a claim with the CSA for her to pay him. Because it doesn't look like she is going to 'fess up to no longer being the PWC (for the 16 yo) anytime soon.

And it won't drop by half, so you need to get it calculated properly.

  • Hi, it doesn't matter anymore that the ex is on benefits. She now keeps her benefits and child support.

You will need to apply for child benefit to be paid to you directly now for the 16 year old. Then you'll be in a position to apply for maintenance from the ex. I don't think there is much the ex can do to prevent you from doing that.
  • The ex obviously doesn't want to 'fess up' to her son no longer living at home as it will mean a big drop in income. All you can do is apply to the Child Benefit for transfer of payments to you, and the child tax credits and csa will then pay where the cb goes x
