Divorce, then Bankruptcy

I was divorced a month ago, sold the house I jointly owned with my partner and allocated all the proceeds to her and my two children as a settlement for the divorce (c£40k) - specifically as I was the reason for the divorce.
However, as I am now considering bankruptcy to clear my sizeable debts, I am now wondering if the proceeds from the sale of the house can be taken into account (and therefore taken from my ex) as I have no other assets of worth that could be considered.

Thanks.

  • Was the £40K part of the divorce settlement agreed by the solicitors or a private agreement between yourselves?

The OR can recover the money if there was no good financial reason to split it that way, and it was not awarded by the court as opposed to being consented to

The £40k was a private agreement between us as it was her father who forked out most of the money for a deposit on the house (£20k), and the rest is to set them up in a new home.
