F & F void - want full payment

I had a full and final settlement arranged with Intrum Justicia. Debt was £1700 and the F & F was £1300. I'm about 8 days late in paying it because I was waiting for a third party to raise the cheque. I've now got the cheque to send to Intrum Justicia today. A woman from their legal department phoned me today and said the F & F was void and so the £1300 was now a part payment and they will continue to pursue for the balance.

Is there anything that I can do?

  • Did you have anything in writing ? if not, then there is not a lot you can do about it,

    nonetheless if they have offered this once, they will offer it again so keep pushing, and make sure you get an offer in writing before you settle

    Yes it was in writing confirming the F & F amount. They then sent another letter after the payment due date saying the F & F was now void.

    Did they send the letter saying the F&F offer was void before or after you sent payment?
  • try to re-negotiate, if they get silly just tell them you have plenty of other creditors and that if they don’t want the money in F&F your sure someone else will ! they will soon stop their silly games !

    They've not got the cheque yet - it's in my bag ready to post today. I should have called when I got the void letter but I couldn't face it (they are like robots).

    ah sorry my mistake. I would do as file_wizzard said then, say, ok I'll pay someone else off instead. I'm sure they will soon come round to your way of thining ;)
  • I was told f&Fs were only valid for 30 days or up until a specified date. Once that has passed they don't have to accept it. I would try to negotiate another one. December is usualy a good month to do F&Fs as the DCA's are desperate to get payments in as people 'forget' to pay then for some reason.

    They had only given me 7 days to pay. The annoying thing is that the cheque has been issued by a third party, otherwise I would hold on to it and try to re-negotiate.

    I would still hold on to it, whilst you negociate. Write to them and state that you are not in a position to pay any more but you can and will pay the original offer providing it is in full and final settlement.
