threat of charging order on house

Hi everyone

I am new to this site but have been googling all morning as sick with worry over a debt I have. I'll try and make it brief. It was a credit card taken out with EGG, got into about £4000 of debt with it about 8 years ago. I was unemployed and basically lived off it and couldn't pay it back. It was taken over by 'Capquest' who I've just been reading horror stories about and I set up payment arrangements with them. I really don't know how much I have paid off but for around 2-3 years I paid £40 a month then it went up to £50 this kept happening and I would get a letter every few months to say it was going up when it got to £90 I couldn't afford to pay it. I'm guessing I must have paid at least £2000-£2500 off. I then didnt pay them for a while. i got a court order last year when I was on maternity leave they said I had to pay £250 a month I disputed it and I also asked why the debt was still £5000 after all I had paid. I never heard anything and I wrote to them to ask how much I had paid, still nothing. I offered the court £30 a month they agreed and I waited to hear from capquest regarding this. I heard nothing and then this weekend I have been sent a charge order on my house for £5400. I felt sick, my husband knows nothing of this debt, it's not his debt and we jointly own the house.

I feel frustrated at the amount I have paid them. I rang and said that an arrangement had been set up for £30 but they said I should have been in touch with them not waited for them to get in touch with me. I was very upset on the phone but they were very unsymapathetic and said I could make a payment of £30 there and then as it would look like a goodwill payment. i wish i hadn't as it seems any money i pay doesn't come off the debt

As I said, I have read lots of things about capquest and it has made me very angry and now I want to go to the court hearing to appeal. i have read that capquest have to legally provide me with a copy of the agreement with EGG to see if they bought my debt, i'm hoping they have to provide an amount I have paid.

In a way it would be good to go to court to see if they let me pay in installments and stop the interest as I am getting nowhere with all I have paid. Capquest are awful to deal with and would not listen to my request to pay them each month. The charge order letter came from HL Legal which I have now found out is Capquest

I suppose what I'm asking is how do I prepare to appeal. I'm frantic with worry over this
