husband not paying mortgage

My husband was charged with assault against me and my daughter in september last year and since then has paid nothing towards any of the bills including the mortgage. There is an injunction in place so he cant contact me or come near the house but in the begining he was contacted and asked to pay by my solicitor and he never responded.Does he have claims on the house still ? and is there anything I can do to make him pay, basically what are my options ? he hasnt paid a penny and I have paid for everything, he earns over £40, 000 a year so can well afford to ! Ido get money via csa for my 2 boys but even that has to be deducted from his salary. I would be really grateful for any advice as he has left me with huge bills and we have virtually nothing left for food etc.

    you are both liable for the mortgage if in joint names, cant see why he would be for the bills though.

    Every case is different. Unfortunately this really is one for your solicitor.

    Perhaps selling the property and moving to a cheaper one, in your sole name, is the way forwards.

    These situations are invariably complex and differ from case to case. Therefore you need your solicitor to give you specific advice. Unfortunately a messageboard is unlikely to help you much in these circumstances.

    With two kids you should be receiving about £490 per month via the CSA (20% of his take-home pay) and tax free.

    Your solicitor doesn't decide who pays what.....they don't have any power what so ever...only a court can decide that.

    Relying on someone to pay your bills that you can't rely on to keep his hands off you (in a bad way) is rather silly.
    If you find yourself in a fair fight, then you have failed to plan properly

    I undertand your point but it is difficult to make a judgement when only one side oif the story is available. Besides, we are not here to make that judgement.

    As I pointed out, he is required to pay a considerable sum in Child Support. To expect him to pay a mortgage on a property that he cannot visit is possibly expecting too much. He'll need to rebuild his life too.

    The alleged domestic violence issue is a side show. There are laws against violence and the punishment can involve fines, community service and/or imprisonment. It doesn't carry an enduring requirement to support the victim. However, failing to pay the joint mortgage will see the lender chasing both parties if it gets into arrears. It may even lead to eviction.

    The sooner this issue is resolved the better. Nobody wants the children to see their parents fighting/arguing. I hope it can be resolved amicably.
