Blair Oliver Scott and AA Loan big ol' mess!

This is a duplicate from my thread on the DFW forum but hoping that someone on here might be able to help...:)

I'm just fishing for any help/opinion on the current mess I have found myself in with an unsecured personal loan originally taken out with The AA Personal Finance.

Loan was taken in May 2008 but I hit financial hardship in May 2009 and managed to arrange £1 monthly payments, which ran successfully with The AA for 5 months. The account was then passed onto Blair, Oliver and Scott just at the time that I was updating my financial situation and increasing my monthly payment proposal. Always on the side of caution with these companies, I requested confirmation from The AA and Blair Oliver and Scott that they were the ones who I was to forward all future payments, of which I received from both parties.

So I have duly been paying BOS my agreed monthly payments in full and on time, with proof of each transaction. March this year I received a statement from The AA which does not show any of the payments I have been making to BOS at all. The payments in stop at the last £1 payment I made to The AA in October 2009. I wrote to both parties telling them to sort this out basically, providing copies of all correspondence and relevant documents, hearing nothing more from them.

Three weeks ago, landing on the door mat all at once, an Annual Loan Statement from The AA, NOT showing any payments since Oct 09, a letter from BOS claiming that I have “failed to respond” and demanding full payment, and a letter from a new third party sticking their oar in Moorcroft Debt Recovery shouting loudly in big red letters to “pay up or else”. Even though I have been paying the company I was told to for the past 7 months.

So again I pointed out their mistake, sent copies of all correspondence etc (always recorded delivery btw) to all parties and asking for a solution.

The only letter to come back is from Moorcroft (well at least someone has responded!) writing to “confirm we require a monthly repayment proposal you can afford and maintain, to enable us to assist you further” Oh yeah, I know, I will start paying yet another party claiming to own this debt and let my money just disappear into thin air!

Sorry for the long story but I’d really appreciate any thoughts on what my next move could be. I’m loathed to keep paying a company who appear to just be sitting on my cash! I have checked, double checked and triple checked that this is not a mistake on my behalf, all account details etc are accurate and I am in fact in a payment agreement with BOS for another debt, all of which seems to be running ok.

Thanks in advance :A

You seem to have done everything right. But just to check, you have receipts or proof of transactions for all payments you made?

I suggest you check all the account numbers. If the AA are using one account number with themselves and BOS have their own account number you might find none of the individual companies involved can tie your letters to your actual account with them.

If that fails escalate an official complaint with the AA as the original creditor.

Thanks for your reply Xbigman

Yup, I have proof of all of the transactions paid to Blair Oliver and Scott. I have looked closely at all account numbers and from what I can see they all tally. I will be checking again though. It seems such a ludicrous problem!

Looks to be that the next step is to log an official complaint. I feel that I've done everything 'by the book' and have given them ample opportunity to sort it out between themselves!

I would log a formal complaint, its upto bos to chase its agency not you. Send a letter to moorcroft advising any action by them will be defended with a counter claim.

Many thanks for you input :A

Complaint is written and ready to send via recorded delivery today. I am sure that this will take some time for them to sort, I'm concerned that my monthly payment date will arrive in the meantime. I do not want to stop any payments on my account but at the same time I am loathed to continue paying a company who seem to be eating the money!

Interestingly I had another letter from Moorcroft over the weekend (dated just 2 days after the last letter) to confirm that they are currently dealing with this account. I'm pretty sure they won't want to be dealing with it for long...
