personal loan - annoying calls

my hubby is late on his pymt for his personal loan.

EVERY day the funding corporation (provider) have rang him AND sent a letter, even though he has spoken to them every day to let them know that he can't pay it until next wk (payday). the 1st lady agreed that this would be fine, but now it's not and they have sent a default notice.

my big concern though is that the phonecalls he receives everyday, twice a day are from a computer letting anyone who answers the phone know that it's from the funding corporation and it then says if you are XXXX please 1, press 2 if not.

if no1 is pressed it says please note that you have overdue payments on your account, please contact us before you incur further charges.

does this breach data protection laws?
Lead me not into temptation, I can find the way myself.

    I'm pretty sure it does. My understanding is that companies/banks should not confirm whether an account is held to anyone other than the acount holder, a person the account holder has given express consent to discuss accounts, and the Police, if the account holder is under investigation for a criminal offence, ie fraud. So yes, to my mind this is telling every man and his dog that not only is an account held, but that its in arrears. The only get out I can think of for them if someone complained is that they might profess to have dialled a wrong number.

    You could contact the Information Commissioner, who deal with Data Protection.,for advice.

    next time you ring-ask for the persons name you are speaking to and if possible record the fone call, then when they say "a payment nxt week will be fine" and they start harrassing you, you have proof that you have explained your situation and they have no comeback. if you know the time and date of the fonecall where they said it was fine write a letter stating it-as all fonecalls should be recorded,and when they listen to it back,there's nothing they can do as one of there staff said a late payment would be ok!

    i am going to write a letter to the data commissioner.

    i have complained to the funding corp numerous times, but they say they are well within their rights (!)
