Lovely, I post a SOA on here shortly...if they come back though and say they do have the proper paperwork, does the court then allow me to offer a payment plan again? I dont want to defend it and then have them say no it is legitimate, and then me owe the whole amount, coz they are offering me a payment plan now?0

OK well I have filed an acknowledment of service now because it was getting really close to the 14 days deadline...I have written off to Frederickson asking for the documents, so now I just wait I suppose...what I am worried about is if they have all the correct paperwork and can enforce it, will they just say I need to pay it all, or will they offer me the chance to do it monthly in instalments again? Does anyone know? Thanks for all your help so far.0

This factsheet from national debtline might help : http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=20_replying_to_a_county_court_claim_form
You need to file a defence before the deadline and this is what it says
"fill in the ‘acknowledgement of service’ form and tick the box to say you wish to defend all of the claim. Send the form back to the court within 16 days. This gives you another 14 days after that to complete your defence form and return it to the court;"0 -
OK, within the court correspondence you’ll have received a login & password, use those to login on the website and acknowledge the claim, you must acknowledge the claim, failure to do so will result in a CCJ being awarded.
Once you’ve acknowledged the claim you’ll have a further 28 days to file a defence, this is where you need to decide what your defence is based on.
RAS, can I just check something with you? You say that once I have filed the acknowledgment I have a further 28 days to file a defence, but when I looked at the paperwork it seems to read that I have 28 days from the date of service, which if I have worked it out right is this Thursday? What if I havent heard back from them, what do I do then? Sorry to keep asking questions, thanks very much!0
