Barclays and RMA

I've just received a letter from Barclays saying they has transferred my account to RMA and will no longer except any further commincation from me.

To give a breif history:

I had a severe mental breakdown in 2003, and have not been able to work since.

When Barclays opted me into the Reserve Fee scheme I was not well, having a bad patch of depression and did not opt out.

I got caught by a few charges because the Reserve is instant, in the past I had managed to get money into the account to put me back on the right side of my limit within 24hrs, so had only gone over my limit twice since getting ill.

The Barclays fees mounted til i was paying £22 a week for the Reserve Fee which meant every other bill I had slipped behind too.

I switched everything from Barclays to another bank and recieved a backdated claim on DLA which allowed me to clear my other debts but not Barclays.

I have tried to contact Barclays about repayments or a Full and Final offer, but of which they rejected, although I have still been paying £30 a month into my account.

I put in a complaint with the FOS because Barclays refused to communicate with me, and continued to charge interest. They gave Barclays 8 weeks to respond and on the end day of that 8 weeks I got a call from RMA.

So... I don't know what to do now, any advice would be appreciated. Do I stop the £30 payment into the Barclays account? Do I resend everything I sent to Barclays to RMA, the SOA and offer of payment etc. And is it worth contacting the FOS again?

Also I asked Barclays to remove my phone number under the Data Protection Act and they have now past this on to RMA, is that a breach of the Act?

    Is the matter still with the FOS? If so, then you should send a letter to RMA, stating that the matter is with the FOS and that you will not deal with them while this remains the case. And I think another letter to the FOS, stating that Barclays have passed the debt on.

    The FOS sent a letter saying they would give Barclays 8 weeks to respond to my complaints. That 8 weeks has now past and I havent heard anything from the FOS.
    I was away visiting family last week, which was essentially week 9 since the FOS letter.
    I dont know if that means the case is still open or not, as I have had no response as yet.

    I think you will need to prompt them to take another look and see that the case is still active.

    They should not have passed the debt on, but as the debt is still active (although there is a dispute), they are still allowed to process your data. A couple of letter are called for as DVardysShadow says.

    Thanks for the advice both of you I will send out some letters tomorrow.
    My problem with Barclays wasnt that they passed on my data but that they passed on my phone number which they agreed had been removed from my records. I use the phone only for family and friends and essential calls to my doctor, counsellor or when it absolutely cant be avoided.
    What annoys me most is I'm not trying to avoid the debt but no one will communicate with me in a helpful way to work towards dealing with it.

    I don't really have any advice to give you apart from what others have already advised, but I would like to know if you have put a complaint into The FOS and it has been aknowladged by the FOS, can the creditor who the complaint concerns pass or sell the debt on whilst the complaint is ongoing.

    If so does the complaint then belong to the DCA who has bought the debt or the original lender.

    I divorced and moved and so my barclays a/c was sort of in lingo and the overdraft kept acruing charges. so much so that now i owe 2 1/2 grand. I offered to pay it back at £60 a month and they rejected this, so i got help from credit councelling and submitted my financial statement to barclays who then asked for £1 a month. I wasnt happy, increased it to £5 monthly and set up standing order. I have paid this, but my direct debit for a loan which is near completing, got cancelled by me by mistake and I rung Barclays to reinstate it and also submitted a direct debit mandate. This hasnt been done. Every I write to barclays, I get ignored, I now have recieved letter from RMA saying they are dealing with my debt. But they are so agressive and say that £60 a month is not enough. That is all i can afford
