Help debt stat bard still being hounded

Hi All

Please any help is apreciated i have been hounded for a debt in 1992 by fredrickson i have read your forums and sent stat bard letter i then recieved letter from Brian carter solicitors and they have also written

I then sent formal complaint letter and recieved there complaint terms but they are ringing me at work and my employer is thinking i have problems everytime they phone i ask for work number to be removed and they say it has been done and again 2 days later another call

today i recieve another letter with payment card and it states this debt will not go away i have not admitted to this debt and had no contact for over 10 years

Is there someone else i can complain to because i deal with money at work and if they think i have money problems i could lose my job plus i am in an open office and everyone can here

Thank you for any advice

and if so have you reported them to the OFT and trading standards as threatened?

    Hi Sophie563
To add to Tixy's comments this will also apply.
    Unfair debt collection practices

This document sets out many examples of what the OFT consider to be unfair debt collection practices. These include:
    • Calling you at work without permission
    • Discussing your debts with an employer or family member
    • Refusing to deal with advice agencies like us
    • Pressuring you to borrow more money to pay off debts
    • Pretending to have legal powers they do not have
    • Adding unreasonable charges
    • Continuing to contact you when the debt is being disputed
Suggest you call the OFT and complain. Hope it goes well for you. DL.

FOS is useless at dealing with statute barred complaints, as they do not acknowledge the limitations act, which is a law! Odd i know.

I would send the 3rd template Tixy posted, and fire a complaint to trading standards / office of fair trading.

As to phonecalls at work, no debt collector is going to volentarily remove data, and unless the request is in writing they do not have to remove it. A debt collector can contact you by mail and thats all they need. So using data protection act you can send a legal demand for them to remove your telephone number from their systems, home and work. Especially the work number as that is for work not personal use!

If it is stat barred then it is stat barred = end of.
Fredricksons know this & so does Carter, yet its typical of them to still try it on.
Report them to the OFT & trading standards.
The sooner Carter gets closed down for good the better.
