    No. It was a guide price, they can bill you the cost of goods on Say if something is on offer and expires on the day delivered. They had no intent to steal, it is simply that an offer finished. I can not see this is different.

I told the guy I did not agree to this amount being taken from my account and I didn't want any of the nappies if this was how they were going to treat their customers. I did not receive a call or e-mail or anything. Surely they could have sent an e-mail cancelling my order from their end rather than charging me £130!! How were they to know you did not want the £130 order?

    My sister had the same thing happen to her. We are calling them later although it will prob get us no where. The least they should do is offer say two boxes for £1 each as a good will gesture but no, not even a phone call. They let their delivery men do the hard job and tell the customer and have to deal with things - that's just wrong! It is a simple misprice, although I have not checked, generally they are within their contract rights to cancel any orders before dispatch. If you would have accepted the order, it would be a whole different scenario! You knew it was a misprice and knew that they could correct it before it arrived?

    I know when Amazon did a similar thing it all went to court and they didn't have to honour the orders because a receipt did not get sent to the customers detailing the 'cheaper' price. However, Kodak did send their customers an online receipt with the cheaper price and the court said they had to honour all orders. I have my online receipt which gives price of £30.00 (for other things other than nappies too) so I'm hoping this will be the case with Asda - I will be ringing them later but if anyone could shed light on the theft issue that would be fab? Surely we had a contract with them to buy nappies for £1 and they have broken their contract too? Criminal or civil law - I don't know! Any advise really appreciated. You rejected the order. They made a mistake, they will refund immediately. Not much else they can do?

    Another thing to bear in mind is whether this additional charge will incurr charges from your bank etc (afterall, it is the end of the month!). They take the money out of your account and it goes into a holding account and it is when you agree to the charge when they are at your door that this money then goes into Asda's account (this takes 2-3 days to get to Asda apparently) so surely it will take the same amount of time to credit your account and in the meantime, you are being charged penalties for going over overdraft or something and they are repeating benefits of interest for those few days from all the customers rejecting the orders! I know one thing is certain, I will be going to the small claims court if I get bank charges exceeding the cost of bringing a claim and in that I will include interest etc - I'm going to try and fight this all the way - they can't get away with it. Its their fault/error! You had no idea this was a misprice and they may bill you the correct amount? Because if you did know, then the fault lies on your shoulders also.

    Sorry last bit, lots of people were buying them instore for £1 and they aren't being chased for extra money - discrimination surely! (although not sure what kind - internet buyer discrimination maybe!!! haha). Anyway, it was noticed at 8am in most stores so why hadn't they realised until after midday (which is when I placed my order) before they stopped the internet buying too - very slack on their part!! I'll stop ranting now. Thanks all

    If you get a delivery today, the amount has been taken from your card probably. So it is worth accepting the order and arguing with ASDA to refund the difference. If they will not, out of goodwill then ask they collect. They may also refuse and suggest you return to store. There is not much you can do other than hope they will. Tesco normally honour, but I can't say about ASDA personally.

    Yes you could claim 'loss of a bargain'. Either if you accept delivery or refuse it. However a judge needs to believe that you genuinely believed that it was a true offer and not a misprice. I would personally not believe someone thought it were a true offer.

    As for bank charges, a judge may on the back of a 'Loss of a bargain' case. Highly unlikely as a small claim as you were fully aware ASDA has the right to bill you the price in store that day. Unfortunate if you get charges, maybe a result of ASDA, but their fault? Hardly. The guide price is simply, a guide!

    I have never ordered glitches from Tesco, unless I know my bank account can take a correct amount being billed and that if Tesco refuse to refund the difference(never have-yet) that am able to return to store(ie not fresh/frozen) or accept the true price. If you order glitches/misprices as lots of MSE'rs do, sometimes they will bite you on the bum. We know it can happen before ordering.

    I did not order myself, because I can not easily return to ASDA and I knew it could mean funds out of my bank for up to ten days.
  • My ordered was delivered but there were no nappies. The invoice just said none available but my account says I'll accept substitutions. I phoned to ask why wasn't I given substitutions and the advisor said they surely didn't have anything suitable to substitute with. I laughed and said do you mean there are no size 5 nappies of any kind/brand in that store and he said it does seem unlikely but that was the only explanation he could suggest. I said that is it more likely that they weren't delivered or substitutes delivered because I ordered when they were £1 and they just didn't want to fulfil the order at that price.

    He said he would have someone from the store call me but no-one has. I've called back and called the store but can't get hold of anyone in that department, I'll try again later.

    The thing I am angry about is why lie about it? They should've just said it was an error/they couldn't sell them at that price, not say they have none/any suitable substitutions.

    These kind of glitches are a hit or a miss as to whether you get them and that's fair enough but they should at least be honest about it. Glad to hear that someone has been lucky though!

    i am awaiting a £50 refund from asda for the extra 5 boxes of nappies i ordered i am writing a complaint to them also as i feel its my right as i recieved the confirmation email with them priced at £1 is this not why its called confirmation to confirm items ordered and prices?
