Hi everyone,
ive got a slight problem, im currently going through CCCS and ive been advised to pay token payments whilst my other half seeks more permanent work as hes self employed and nothing is regular,
Ive wrote to all creditors and im starting to get my reponses through with regards to accepting/not accepting the token payment.
i had my first letter from first direct last week not accepting the token payment so i wrote them a letter with another copy of my SOA explaining that i fully intend to pay monies owed and needed a few months for us to get back to a position where we could offer a more substantial payment and asked them to reconsider the offer for a short period of time.
i got a reply to that today saying they still wont accept it and they want £24 a month or they will take action to recover the full amount.
they also added they can see from my SOA that i cant afford more than the token payment, thats a contradiction if ever i saw one!!!
Im stuck as to what to do now, do i write a further letter or just leave it n continue to send cheques to them for the token payment until which time i can go on a DMP.
Any advise would be greatly appreciated

Bumpity bump for anyone that might have a suggestion.
I feel the token payments must continue until the DMP is formally set up but I am not really hot on this topic. Anyone else please?Leason learnt :beer:0 -
I'm no expert at all so this info could be pony!! However I would just tell them in a letter what you've posted here again.
You're paying what you can afford, by contacting CCCS they can see that you're taking positive action to clear your debts. Enclose a £1 token payment and then at least courts / FD & CCCS know you're doing as best you can to put the situation right. You're not shirking responsibilities and you're not trying to avoid paying the money back.

yeah that helps its just hard to remember when they wont take the offer, ill hang on in there and keep sending my monthly payment to them and see what happens next ...

I agree with the other posters......you can't do more than send them token payments for now................you can't give them what you haven't got.....so they will have to accept that....by continuing doing that....you are showing that you are willing to continue paying off the debt and are not 'trying to get out of it'....best wishes XXX0

just send them the amount in your SoA.
its fairly standard practice for your creditors to try to get you to give them more than everyone else... well why not.
just stick your ground and they will eventually agree.0 -

Any of the ones I had that wanted more money from me, I just kept sending a letter with my token payments stating that my situation is unchanged, they have my SOA and list of debts. I also state that it is temporary and it is not that you don't WANT to pay them more, it is because you CAN'T!
I still get threatening letters, and respond to each when I send my payment...so they can't deny receiving it.
A court won't make you pay what you haven't got, and they know that....so they are just trying it on!!!

Remeber they are really just chancing their arm with you and hoping you will be intiminated enough to pay up. They seem to think everyone in our kind of situation is lying to them and can really afford to pay up. Just keep doing what you are doing, letters and phone calls are just that.Julie
