Full and final offers - attempts to reach one

I had a credit card with Sainsburys - some 2 years ago they placed default on credit record and passed the account to the delightful Blair Oliver and Scott who then went on to demand the full amount of repayment.The default happened when I was caring for my terminally ill father until his death. I accept responsibility because I was probably less than attentive to correspondence at that time. In consequence I then paid them monies and then the community legal service managed to negotiate monthly payment arrangement which I have honoured throughout. Following my father's death an amount of money which would amount to over 50% of the debt has been offered to them by me and by a solicitor but they will not accept it. I read on this site about what amount these companies will accept 10, 20% etc. This has not been my experience. Has anyone any ideas as to what I can do next. I have maintained monthly payments and added notice of correction to my credit file as Blair, Oliver and Scott have resolutely failed to provide any statements of the current account or confirm the payments made to them. My main concern in all of this is my credit record

If I could pay the full amount I'd pay but I can't. How can I get these people to see sense and accept that 55% now is preferable to 28 years of minimal payments? I've tried everything

    I read on one thread that Blair Oliver and Scot are, in fact, Bank of Scotland. It is, in my opinion, unfair that they try to pass themselves off as an independent company, but it seems that it is legal (just).
    I would advise going to CAB, as your offer would appear to be fair, and as you say, better than 28 years minimum payment.
    Have they frozen charges and interest? Again CAB will advise.

    Yes they have frozen the charges and interest. I don't think they are independent either - their address is very close to Sainsburys Bank Customer Services which is HBOS anyway isn't it?

    I'll try the CAB but the problem is that they just don't respond to anyone in any meaningful way

    Perhaps you could try writing to Sainsbury's, explaining that you have tried, unsuccesfully, to negociate with BOS. Tell them the circumstances (they should already be aware of this, from BOS, but you don't know this). Make the same offer to Sainsbury Bank.
    If this fails, then speak to CCCS.

    I'm sure payplan and the lieks will engotiate full and finals on your behalf. it is worth writing to them again, stating a relative is stumping up the cash, this is all you can afford etc. Keep going, they will give in eventually. Promise.
  • I was offered a full and final from BOS which i couldnt afford to pay of just over 75%. Not much help but they will come down by this much.

    I'll try Payplan - Unfortunately, I've tried letters to all parts of Sainsburys. They don't respond at all. I've now asked them for statements since SEpt 04 - last statement I had despite all the payments made since then and repeated requests for statements . I've also asked for a copy of the deed of assignment on the debt. Never even received a notice of default. Maybe a barrage of correspondence might make them rethink. The only response received to my offer from BOS was a one liner saying "insufficient funds"
