Yes, OEM software has to be sold as part of a bundle with some hardware. The definition of hardware has always been a grey area. There are many sites selling OEM software legitimately, that will send you a USB cable or similar to qualify as the hardware part of the bargain. As far as I know that is legal.
But selling OEM software on its own? I'm pretty certain thats not allowed.0
