getting paranoid re: reclaiming bank charges

    The problem that the bank has is that if they go to court it will attract a bit of a media circus and assuming you win it will put the idea out there that this is doable. They don't want that, they'd rather deal with the handful of people that stumble across this site than the thousands who are going to see it on the evening news.

  • Yeah, hang in there. They are stalling to try and make you paranoid. They want you to lose your nerve. When Halifax paid out with me it stated in their letter that although they do not admit doing anything wrong, they have decided that it would cost them more in legal expenses to defend the claim in court. I received this about 21 days into the 28 day deadline. Keep strong. It will not cost you anything, and it will be worth it in the end.

    Hi there, hang in there! I had the same worries. A bit of stressing is natural but you will be fine. My bank paid up and then I took a gamble and told them that I would only drop the case if they took back the confidentiality agreement and they crumbled. The banks are in the wrong, they can't defend these claims and they know it. They stall for ages and try to put people off because some people must just give up with all the stress! You'll be fine.

    I suspect many people feel the same and as a result give up, which is why the banks try it on. At the end of the day if they can get 50% of the cases to drop or not pay the full amount they still win.

    Just stick to your dates and then make them sweat and if you threaten to go to court then act like it and that way you can turn the tables on them.

    One of my claims is with Abbey and they are being bit petty over microfiche records which they claim doesn't cover under the DPA, so if they dont play ball it will just be an estimate and a report to the info commissioner, job done.
