Evening all i received a letter from the above today chasing a debt for over 4k, this has been going on for over 9 years from different dca's and in all that time not one of them have been able to prove this debt is mine (oh yeah maybe i should have told you from the start this isn't my debt). So what do you reccomend i do i don't want to ring them after what i read on here today about them, this must be statue barred by now anyway shall i write to tell them this isn't my debt or just send them the statue barred template?

    Send this first You know nothing of the Debt / Prove It

    Then if they play silly beggars, complain to the FOS :D

    If it isn't yours, proceed as if it isn't yours. Arguing Statute Barred implies it is yours, but you are sharp enough to get out of it.

    No, they have 28 days to reply with any formal complaint, and then they can supply a final response, which gives you 6 months to complain to the FOS - as I mentioned in my last post.

    Do not hassle them, send the letter and if they do not reply by the end of June you would go straight to the FOS and formally complain about them. As an aside, does this account show anywhere on your credit file?

    If i seem keen to get in there face it's because this has been going on for 9 years with diffderent dca's and i've had enough, they go away for a while, i didn't hear anything for 3 years then these muppets appear out of the woodwork.

    But this time you're on here and we will speak you through the usual process which takes around 3 months - tops - then it is finished with, forever. Just post here and keep us up to date and we'll sort you with the correct templates and processes to follow. :D
