Hi all. Can someone please tell me if you're legally bound to notify a mortgage company that you're vacating a property on the date of a repo court order. My brother's property was reposessed last Sept and so he moved out on the day before the court order said. I asked where to send the keys but they never got back to me, so I assumed they'd attend with a locksmith and change the locks. We've just learnt they never took possession coz they didn't know brother had moved out. ! My brother is BR by the way and the OR doesn't seem interested in the property.
Any advise please.

    I don't know about legally bound, but I'd have thought it would be sensible to ensure they get the keys and can start trying to sell asap, in order to minimise the shortfall, and avoid an accumulation of charges, interest and arrears.

    He may be BR now, but they can wait 12 years to pursue him unless its included within the BR terms (afaik).
