Why are you claiming that you didn't agree to the £249 when you've known for months that you'd be paying it? Surely you do owe it so shouldn't you just cough up the money?

Let me make it clear. The form was described as form to allow them to speak to the mortgage company with no reference to charges. After the initial thread a subsequent form was sent through (in duplicate) that made no reference to fees - it geniunely was just an authority form for them to disclose information.

  • The document stated that x% would be payable to the mortgage broker upon successful completion of the mortgage by the lender. There was no further references to any charges in any form apart from those mentioned in the threads above (which was a small side print document never signed into). However, this was never discussed at any point and I continually chased the broker for clarification of charges throughout the process without any feedback in any way shape or form. I have maintained contemporaneous records of all correspondence as I had a niggling feeling this one would come back to bite me. Truth of the situation is as follows - I genuinely wouldn't have minded paying the £249 if this had been up front and honest/transparant situation. However, pinning the broker down for an answer was never successful and I begrudge this form of underhand practice. I also don't believe the broker fee should have been put in the completion statement (if they had remembered) anyway - but that is a side issue.
