help on csa dedution of earnings order

hi everyone. i am new to all this.i have a little boy who has just turned 2. his dad left me when i was 7mths pregnant after being together for 5 years . he went off with another woman who already had a son herself then got pregnant by my ex and when this happened my ex stopped paying his maintanence as he says them 2 boys come first not mine. i have text messages from his gf telling me to give up on the csa as she will make sure my son doesnt get a penny and she puts things like im out spending all his money on my boys. shes very spiteful and couldnt care less about me struggling. my ex now owes 2,000 in maintanence and has had bailiffs to his door which he refused liability orders on him and he went self employed so they couldnt get a deductionm earnings order on him but now he has gone back into employment and the csa have had recent wage details from his boss and have done a calculation at £37 a wk but this took the csa 8wks to do and they said they are in process of setting the deduction of earnings schedual up. does anybody no how long it is going to take as i am worried he will leave his work again and go back to self employed to give the csa a runaround again. this is causing me so much stress and upset. all i wanted him is to be a good dad and pay towards food nappies and milk but looks like its never going to happen. please reply if you have been through this yourself or have any info for me on how long this process may take. x:)

    Hi Jess, the process maybe quick or it may take longer than the child reaches adulthood, so don't get too excited or reliant upon regular child support, after I sent my paperwork in, the due date was about 6 weeks , DOE's may take a little longer as I understand they take it on a certain date of the month, then pass it over. The NRP may not be in the same job for the next 17yrs so you could be in for a roller coaster time :o

    Sorry Jess but we are all in the same boat.

    We all have our tales to tell, and mine has been going on for 15 years, so expect nothing, keep on at them and anything after that is a bonus.

    Keep posting if you need any specific advice though, lots of has have/are up against the hurdles with the CSA that you are/will be up against

    Chances are when his employer tells him about the deo he might quit. Its what my ex done meny a time and went from job to job before going self employed. 6 years and not a penny. People like that know how to work the system so to speak
  • Your story is like so many..including mine.

    Having a DEO in place doesnt mean a smoth ride either. My ex has had 1 in place since Jan last year and my payments have never been the correct amount and many months have gone without. The CSA keep sending letters but not acting on them...this month if no joy i shall get my newly appointed MP involved.

    I'm afraid all you can do is hope and wait. Do keep on to the CSA and hopefully you will get your money...fingers crossed.

    It took four years to sort out my children's maintenance. I finally started to receive it via a DEO last year. I also get arrears. I'm one of the lucky ones, as my ex has not quit his job.

    If you get a DEO in place and the ex doesn't quit his job, then keep a close eye on the payments.

    I found that I have to phone the CSA just after the 19th of each month to remind them to remind the employer to pay the money to the CSA. Then about a week later I phone to remind the CSA to pay it to me. This process usually works but there have been missed payments and delays. For example, my ex changed jobs in March and I haven't had a payment since but have been promised the next one at the end of June. :(

    Try not to rely on this money, but look on it as an 'extra' because it is by no means guaranteed to arrive each month.
  • 9 years here and still waiting. Like others have already said, some ex's know how to play the system. So don't hold your breath. The important person in all this is your child. So do what I do, and just enjoy the time you have together and don't worry about the money. Thank goodnes we live in a society that helps parents like us financially with the benefits system.

    I'm not saying to give up on your ex, I'm just saying to not look forward to any financial help from him, as it may never happen.
