Advice please.

I'm not sure where this is best posted but was helping someone could help

My friend has just been dismissed from his job.
He was doing really well at clearing his debt he had just arranged to start seeing his kids again but last week money went missing from work. He cashed up the till and placed the money in a capsule which he then dropped into the safe. There is paper to prove that the drop was made. When the capsule was opened the next day it was claimed to be empty.

The main manager claims to have been present at this opening but evidence from others would show that this isn't the case and he has lied about other things before. He was not interviewed before facing a disciplinary where he was asked to leave. He informed them he wished to appeal and this is set for next week.

From what i can see they do not have proof that it was him but equally he does not have any to prove it was not.

The only other comment is that at his job part of the facility is under going major refurbishments and management had asked for someone to be made redundant. Middle management has said no. So to me this looks like away to get rid of someone. Also my friend is not stupid and wouldn't steal money

From my understanding as he has only had this job for 6 months he does not qualify for unfair dismissal but i was wondering whether he could prosecute them for deformation of character. Also as he currently has no income after been shown the door where can he go for help. It really upseting to see someone who was doing well being stopped in there tracks.

    Is he in a Union? If he isn't he needs to join one ASAP - as that will put the wind up the management!

  • if this is the true case (not that i doubt u or ur friend so please dont get the wrong idea) then i would inform the company that when he goes for the appeal he wishes the police to be present. As he is being accused of theft then i believe u can do this even if the company is not pressing charges - that way the manager who could be telling fibs about being present would not/or would get himself in alot of trouble if it was proven he was fibbing.

    His first step is to get a copy of the disciplinary procedure. For example, if it says he should be suspended pending investigation; recieve 'x' days notice of hearing in writing, etc, and it hasn't happened, a tribunal would find FOR him in most cases irrespective of the merits of the case - because procedure was not followed.
