DLC HILLESDEAN Ddefault entered 5yrs on!

I'm so angry!

I don't know what Hillesdean / DLC are playing at!

I had an email thismorning to say there had been a change to my credit file and when I checked it Hillesdean have entered a default on an old HSBC debt (still outstanding) from 2005! This wasn't on my credit file before.

I have spent years tidying up my credit file and not this shoes up as a big horrible stain. It doesn't show that I have been paying it off every month since 2005 without fail. It looks like I still owe 4500 even though I have now got that down (albeit slowly) to about 2000.

Why have they suddenly decided to do this?

I'm seriously considering the unenforcability route now. I wasn't going to do this as I didn't want a default on my file but now it makes no odds. IS there anything I can do?

    Quick update! I stuck with it and I got this yestersday from Hillesden / DLC...


    Dear Miss H

    Further to your previous correspondance regarding the above account we can confirm and advise the following:


    1. The original lender has been unable to provide a copy of the documentation you have requested under the consumer credit act 1974

    2. We will not continue with any proceedings on the above account at this stage, however should any documentation become available we will notify you accordingly.

    3. Although we are unable to enforce the agreement at this time, the default will reman on your credit file until the debt has been satisfied.

    I know whe debt hasn't gone away but have the been legally entitled to the thousands they have had off me in recent years without this document?

    Also doesn't the default drop off after 6 years whether satisfied or not as it is the same debt?????

    They can't enforce payment now, but if you did pay before then you can't claim it back.

    Correct.

    Strange wording in that letter, but they probably mean it will stay there for the full 6 years IYSWIM.

    If it doesn't go in 2011, then you can take action to get it taken off.

    Hillesden Securities are pure scum and unless you have a letter saying that the account is close then they will contact you again at some point in the future about this debt.

    The letter does suggest this as its only say that they are not pursuing you at this time but does not say that the account is closed.

    The default will fall off after 6 years whether satisfied or unsatisfied Hillesden know this but they are just lying scumbags
